Missouri: Bills Introduced to Restrict Your Gun Rights





Now that the 2013 session of the Missouri General Assembly has convened, your NRA-ILA has learned of some disturbing anti-gun bills that have been introduced. These bills are designed to infringe upon the rights of law-abiding citizens and would do nothing to address criminal activity.

Senate Bill 124, sponsored by state Senator Maria Chappelle-Nadal (D-14), requires a parent or guardian to notify a school district, or the governing body of a private or charter school, that he or she owns a firearm within thirty days of enrolling the child in school or becoming the owner of a firearm. This legislation does nothing but require a parent or guardian to reveal private information of gun ownership and in no way would this requirement deter crime. SB 124 has been assigned to the Senate General Laws Committee.

House Bill 187, sponsored by state Representative Stacey Newman (D-87), would require all sales or transfers of firearms be processed through a licensed firearms dealer. This type of legislation is the first step in “universal registration” and clearly over-reaches and infringes on our Right to Keep and Bear Arms. Imagine a grandfather who wants to give a family shotgun to his twelve-year-old grandson having to conduct a criminal background check on his grandson before passing down the shotgun.

This thing is DOA in Missouri. It has some liberal bastions but the middle of state keeps it honest.

Yes, id be eager to comply with this awesome piece of legislation. Unfortunately I don't live in MO. I may need to move so as I can confess my sins to a school...

I certainly encourage everyone to write our state legislators. Definitely let them know that RKBA is a voting issue and you appreciate their support of your rights. But I wouldn't dedicate my letter to these subjects, though you can certainly cover them in passing. It is extraordinarily unlikely that either will ever see the light of day out of committee. We get bills like this introduced every year, often by the same legislators. They know they won't move, we know they won't move. It is a bit of theater.

I do urge everyone to let your reps know what you would like. In particular, I believe we need a law to discourage doctors from making notes about your gun ownership in their records, giving firearms advice unless they are qualified, or inquiring about ownership. I'm aware of the FL law, but I don't believe that answers the question. But whatever is your passion, let them know. Open carry, privacy, armed teachers, prosecuting gun criminals, etc are all good subjects to cover.

Thanks for your note Tim. You are preaching to the choir! Obviously, what happened in Newtown is a terrible tragedy, and if there are things we can do to help ensure that doesn't happen again, I'm all for it. But I do not believe that 'gun-control' is the answer. It's simply being used as a political tool for some, and that's unfortunate.

I will work as hard as I can to fight for your gun-rights prescribed in the 2nd Amendment. You have my word on that. And depending on what President Obama and his administration decide to do on a Federal level, we will be prepared to act as needed to protect the rights of law-abiding gun owners here in Missouri!

While these are bills we should be against and by all means we should let our voices be heard.
We also have some good bills introduced in the house that we should call and e-mail our support. House bill 170 has been read and is in the general laws committee. We need to call ask for support of this bill. Contact your reps and the reps on the general laws committee. I've been e-mailing daily.

there's a meeting of the general laws committee next week. They have not decided what bills are going to be heard yet. We need to contact them to encourage them to move on this bill asap.

this is house bill 150. do you think it will pass?
Section A. Chapter 571, RSMo, is amended by adding thereto one new
2 section, to be known as section 571.048, to read as follows:
571.048. 1. Any federal law or executive order, which is more
2 restrictive than the law in effect on December 31, 2012, that bans or
3 restricts the possession of a semiautomatic firearm or any ammunition
4 feeding device or requires the registration of any firearm, ammunition
5 feeding device, or firearm accessory shall be unenforceable in the state
6 of Missouri.
7 2. Any officer, agent, or employee of the United States, the state
8 or any of its political subdivisions, or a firearms dealer that is licensed
9 under 18 U.S.C. Section 923, commits the offense of unlawful
10 interference with firearm possession if such person:
11 (1) Enforces or attempts to enforce a federal law or executive
12 order that is unenforceable under subsection 1 of this section; and
13 (2) The firearm, ammunition feeding device, or firearm accessory
14 that is the basis of the enforcement was manufactured in the state, or
15 possessed in the state, and remains exclusively within the state.
16 3. The offense of unlawful interference with firearm possession
17 is a class A misdemeanor if the person committing the crime is an
18 officer, agent, or employee of the state or any of its political
19 subdivisions, or a licensed firearms dealer, and the offense is a class D

20 felony if the person is an officer, agent, or employee of the United
21 States.
22 4. Any person charged with violating a federal law or executive
23 order that is unenforceable under subsection 1 of this section may
24 request the attorney general to defend such person against the charge.
Section B. Because it is necessary to protect the rights of the citizens of
2 this state against unenforceable federal gun laws, section A of this act is deemed
3 necessary for the immediate preservation of the public health, welfare, peace and
4 safety, and is hereby declared to be an emergency act within the meaning of the
5 constitution, and section A of this act shall be in full force and effect upon its
6 passage and approval.
