AWB sunset - what about "Law Enforcement Only" stuff?

Maybe someone's answered this alread,y but i didn't see it anywhere.

If/When the AWB sunsets, will it be legal to own stuff that was manufactured during hte AWB but marked or stamped with "Law Enforcement only"?

for example, a magazine over ten rounds?

in other words, was "LE only" just a freindly reminder, or an actual legal restriction that can't be reversed?
 
"LEO/Mil only" will be empty words once the ban sunsets, those were the markings specified by the ATF so that civilians would know the magazine was made after 9/94.

I intend to get a few things marked "LEO/Mil only".
Gotta have something to show the grandkids in 50 years so we can all laugh about it. :D

That MIGHT be true of some things like AR-15 lower receivers. But I don't see how that would apply to magazines.

I plan to buy some of those myself. Dark humor.

OK..again..I buy the gun as a smaple or display or for individual sale...TAX PAID..

If I sell them to a Deaprtment...TAX OUT..

I can only sell tax paid guns..

I've got a pretty good grasp of the AWB laws, since I used to have to know em for my job, but this little nuance has me thrown.

If a dealer down here has a LEO marked gun that he bought tax exempt, would there have to be some sort of paper trail that proves he went back and retroactively paid the tax?

Or am I making this more complex than it should be?
 
I believe he is saying that if the weapon has been bought by the FFL (WA in this instance) for the express purpose of selling it to LEO/MIL it is tax exempt. Therefore he (WA) cannot then sell it to John Q. Public since he (WA) did not pay a sales tax on it initially. Correct me if I am wrong, this is not my department at the shop.

You are correct.
The 11% execise tax has not been paid on LEO guns. And there is no provision for an 01FFL to pay the tax, only 07 Manufacturers are able to.

I'm not sure how used 'LEO/tax-unpaid' guns would be handled.

Be patient. The BATF will have the final word on LE stuff. Call them at the sunset and a definate ruling will have been made already.

Who knows if they would use the federal tax issue or some other reason as an excuse to keep them LE only. Very unlikely, but only Sept 14 will tell.

I sold 250 Colt LEO Ar 15s to the Alaska Stae Troopers....those are tax exempt guns...you cant have them UNLESS THE TROOPERS SELL THEM BACK TO A DEALER and THE TAX IS PAID..just like if I sell them Glock 23s....those are the SAME as cilvilan Glock 23s except NO TAX IS PAID....

I sell LEO ar 15s to INDIVIDUAL OFFICERS...we pay the tax...the officer can do what he pleases. with the gun after sept 14..

I am gonna have racks of AR 15 LE marked guns on September 15.I will pay tax on all of them. You all can have as many as you want. The markings are meaningless...

I'm not sure why that statement precipitated a salivation reaction akin to Pavlov's bell... :D

Given that line of thinking, every single one of those old police-trade-in wheel guns back when we all went to semi's should not have been sold to the public. I am sure that those guns never had a tax paid on them, yet they were sold off.

WA did say in his post that if the tax-exempt LE guns were sold back to him by the police, with the tax paid, he could sell them. I know he was talking about individual officers in his post, but I would assume that a consignment deal with a department would operate similarly so long as the taxes were paid when WA purchased them, but I'm not an FFL so I don't really have any idea. Maybe we should let WA clear that up.

Bear in mind this is the same system that called shooting Randy Weaver's wife and infant child a "good shoot".

I'm sure they could make up some law or associate it with another one if they had to.
 
Individual officers always pay tax in...if there is a department trade in that was originally tax out, tax is then paid upon trade in..in theory...

The iisue here is LEO guns already in dealer hands (or soon to be)...tax is paid, so have at em boys!

Don't forget some of us have state level bans, and new mags will have to have some sort of language on them to meet the requirements of the state laws.
 
Why risk it? It is used equipment anyway.

Sure, you could defend yourself in court against some aggressive DA. You might even win. But, are you ready to pony up the bucks to do so? Ready to risk the chance it is a felony or other obscure law that can be used to deny you possession of firearms?

As was already mentioned, are you willing to bet you are conforming to ALL the laws, even local, state laws? Hmmm.

Buy new stuff.
