Final word from me. I think it's important for the little people to insist that corporations act in a fair and just way. This small matter is really no different than an insurance company wrongfully denying a claim. It's a breach of a promise, a contract. Make no mistake that when a retail company offers a product for sale and you accept it this makes a contract. If the terms and conditions of that sale are clearly outlined and you accept that and try to buy the product which they then refuse to sell to you that is a breach of contract. A contract in retail settings begins with two essential elements, offer and acceptance. As soon as I go to the counter and try to pay, I've accepted the offer. If someone posts a price at Sears for a tool I want, they can't at the last second when I try to pay say, "oh, the price changed, but we forgot to change the sign". Sorry buddy. That sign was your offer.
What Bass Pro could possibly be in trouble with if they continue to not honor their own price matching policy as I've read in online stories is what is called in Florida a violation of the The Florida Deceptive and Unfair Trade Practices Act (“FDUTPA”). FDUTPA is a consumer-protection related law designed to allow parties to sue other parties for deceptive and unfair trade or business practices. This could potentially turn into a class action against them and they would be on the hook for major attorney's fees. So, if BP reads this, you have been warned. Don't say you didn't know.
