Hey Guys,

I was wanting to take my M&P 15 AR over to NJ to shoot with my brother this weekend. I think that it would be illegal to own this gun in NJ, but would it be a problem for me as a lawful owner in PA to bring the weapon over for the weekend to shoot at a privately owned hunting club range? Please help me out.

Thanks!
Steve

Unless the M&P has a fixed, non-adjustable buttstock, and has either no muzzle device, or a permanently-attached muzzle brake (can't be a flash suppressor), and has no bayonet lug, it is not legal east of the Delaware - not even for a minute, and not even if you have a personal invitation from the superintendent of the state police.

And even if it does conform to the above, it can not be accompanied by any magazines over 15 round capacity.

Just leave home without it.

Even if it doesn't have two of the EBR features, if it is on the list of evil names it will still get you a felony:

Algimec AGM1 type
Any shotgun with a revolving cylinder such as the "Street Sweeper" or "Striker 12"
Armalite AR-180 type
Australian Automatic Arms SAR
Avtomat Kalashnikov type semi-automatic firearms
Beretta AR-70 and BM59 semi-automatic firearms
Bushmaster Assault Rifle
Calico M-900 Assault carbine and M-900
CETME G3
Chartered Industries of Singapore SR-88 type
Colt AR-15 and CAR-15 series
Daewoo K-1, K-2, Max 1 and Max 2, AR 100 types
Demro TAC-1 carbine type
Encom MP-9 and MP-45 carbine types
FAMAS MAS223 types
FN-FAL, FN-LAR, or FN-FNC type semi-automatic firearms
Franchi SPAS 12 and LAW 12 shotguns
G3SA type
Galil type
Heckler and Koch HK91, HK93, HK94, MP5, PSG-1
Intratec TEC 9 and 22 semi-automatic firearms
M1 carbine type
M14S type
MAC 10, MAC 11, MAC 11-9 mm carbine type firearms
PJK M-68 carbine type
Plainfield Machine Company Carbine
Ruger K-Mini-14/5 F and Mini-14/5 RF
SIG AMT, SIG 550SP, SIG 551SP, SIG PE-57 types
SKS with detachable magazine type
Spectre Auto carbine type
Springfield Armory BM59 and SAR-48 type

USAS 12 semi-automatic type shotgun
Uzi type semi-automatic firearms
Valmet M62, M71S, M76, or M78 type semi-automatic firearms
Weaver Arm Nighthawk;

For example, if you put a straight stock on a Mini-14 receiver with an "F" for "folding" stamped into the receiver you are still a felon!

IIRC there is no Mini 14 witha "F" stamped into the receiver. F was part of a model number. Ruger ran a separate block of serial numbers for folders IIRC which had say a 123 prefix and full stocks had say 456. Sometime after the NJ ban Ruger changed their numbering system so all Mini 14s were made with 789 prefix. Folders were randomly picked out of production. I've seen folders that were a few hundred numbers away from a regular Mini 14. GB models came with a flash surpressor, bayonet stud, and in both folding and fixed configurations. If you had a GB in a full stock and cut off the bayonet lug it would be the same as doing it to an AR to bring it into compliance.

We all know how a flash surpressor makes the rifle so much more deadly and capable of firing faster and the hundreds that are bayoneted each year.

There is no pass for any non complying "assault weapon" in NJ for any reason. The only defense is if you were going from PA to VT via NJ FOPA should cover you.

Bushmaster is 100% on this. If you have a AR15 with a full stock, no flash surpressor or bayonet lug it is illegal in NJ because it is stamped AR15 on the receiver.

Don't bring anything semi-automatic to NJ.

There's a reason why all my rifles are bolt action, and not because I don't like semi-autos!

There is a certain irony with so many new england states being antigun

As Liberal as Maine is, there are no major gun restrictions.....surprisingly. I have owned a few guns on the "Evil firearms" list, and Maine has no problem with it :)

There is a lot of misinformation about New Jersey.

All I know is that you have an M&P15.

If yours is a "compliant" model and is as described by Tom488, then you are fine as long as you have magazines that are 15 rounds are less. My guess is that you probably don't have a compliant model (pinned/welded muzzle break, no bayonet lug) but the M&P15 Compliant model is sold in NJ. The M&P brand is perfectly legal here. I was just looking at one a few days ago.

New Jersey is not this horror story that people make it out to be. There are over 1 million gun owners in this state of 8.7 million. This is more than all of the standing armies of Europe (excluding Russia), combined.

A lot of the kafkaesque stories that come out of New Jersey regarding guns are rare. I've been shooting for 25 years and know quite a few gun owners. Nothing horrible has ever happened to any of us just because we went down to the range to shoot.

Check the laws and bring something that is NJ legal. Transport it according to NJ law, and enjoy the day with your brother.
