Man spared jail over self-defence knifing

A disabled man has been spared jail after stabbing a man who smashed his car windows.
Instead, Dean Kilworth, aged 21, of Franklin Court, Nuneaton, was given a two-year community rehabilitation order after pleading guilty to a charge of unlawful wounding.
Warwick Crown Court heard how Kilworth's car windows had been smashed by Stephen Glover after the pair got into an argument at the Griff House Hotel in Coventry Road, Nuneaton.
Ian Suggett, prosecuting, told how Kilworth had confronted Glover and two friends in Marner Road, close to the hotel, last October. A fight had broken out and it was then that Kilworth used a knife to stab Mr Glover in the stomach.
The victim required an operation because the knife had punctured his stomach wall.
But Kilworth claimed that when he confronted all three men about the damage to his car, Glover punched him to the ground.
Lawrence Watts, defending, said Kilworth's mobile phone and a pocket knife had fallen from his pocket and, as he was picking them up, Mr Glover moved to punch him again.
He said Kilworth swung out with his left hand in self-defence, not realising the knife was open.
Mr Watts said Kilworth had suffered a stroke as a baby and could not balance well. A car accident last year had worsened the problem.
Judge Richard Cole said: "It is clear you had an intention to defend yourself but the kind of defensive action went too far - you could have hit a vital area and killed someone. But you have no previous convictions and need help rather than punishment."
