So, I'll go ahead and admit it. The process for buying guns out here in CA is completely beyond me. First question, since I am currently charged with Carrying a Loaded Firearm in Public(Not convicted, not been to trial yet) so can I even Buy a firearm in Ca? Second question, does it matter that I am from out of state? Not a CA resident, but am stationed here active duty... Thirdly, If I'm NOT allowed to buy a gun in CA, can I buy one online from outside CA, and have it shipped here? Will it matter that I have a gun related criminal charge?

Easy questions first:

If you are PCSd here, you are functionally a California resident; your military ID will satisfy for gun purchases.

No, you may not buy guns online directly, either instate or interstate; they must go through a California-licensed FFL.

Now: the loaded firearm charge. I don't know for sure, but I think it's likely that the charge will show up when the state runs the background check. Misdemeanor violation of PC 12031 is not on the list that CA-DOJ publishes of crimes that create firearms disabilities. But 12031 can also be prosecuted as a felony. I don't think that's the case for your event, but you ought to know how you were booked.

If you really want to know your status, cheaply, and not get dinged for illegally attempting to get a firearm, download and file this form: Personal Firearms Eligibility Check Application; it'll cost you $20 and a notary fee, and apparently isn't real high on their priority list
DOJ will make every effort to process PFECs within 30 days, however, please allow 90 - 120 days for the processing of your application. You will be notified via U.S. Mail.

ETA -- since you go to court mid-month, don't you think it'd be wiser not to post in public gun forums for a bit? You might ask your lawyer...

1 Chances are very high that will prohibit you
2 Active duty, is a res of CA after I beleave 30 days( its been a long time)

3 still skrewed as it would have to go thru a dealer in CA for it to be legal. There is also a chance that you are on the federal prohibated list as well.

I don't know the circumstances of your arrest, but in CA any gun charge is bad news. What most states treat as misdemeanors CA treats as felonies. You could be in serious trouble with that charge. Get a lawyer and don't admit to anything.

As for the laws in CA, it is perhaps the most anti-gun state in the nation. It sounds like you had no idea what you were getting into when you relocated there. It is NOT a gun-friendly place.

Good luck.
