Greetings all,

I have an interesting situation that I would like some advice on.

Given:
1) I am a California resident.
2) I know a girl and her boyfriend in Arizona. He is a law enforcement officer.
3) I wish to purchase firearms (specifically an AR-15 and an AK knockoff) that are not legal to own in California. :banghead:
4) They are willing to store the firearms in Arizona until such time I move out of California (probably within a year or two).

Is it legal for me to travel to Arizona, purchase the rifles by producing my California ID, and have them store the firearms at their residence until I pick them up?

As best as I can tell, it's illegal for me to bring the rifles back over the border ("assault weapon ban" and all), but I don't believe it's illegal to purchase rifles in a state in which I'm not a resident.

If it is, I suppose I could have them purchase the rifles and then do a private-party sale (for a dollar or something) to me, which is legal without paperwork in Arizona. I, obviously, have a clean background -- the worst offense I have is a parking ticket I paid off the next day.

Does anyone here have experience/advice in this regard?

Thanks.

I think you'll have a hard time finding a FFL willing to sell those rifles to a resident of California. It would also be a straw purchase if your buddy bought them for you. I believe you'll have to wait until you are out from behind enemy lines.

Of course, I've been wrong before...

Hmm. True.

I also have a Military ID if that would make much of a difference. *shrugs*

Oh well. I'll be moving out of here soon enough...

If you're moving out soon anyway, just wait.
No sense getting involved in dubious gun transactions, when you can do it on your own soon enough.

It's not like you gain anything by getting them now. The AWB (Federal) is gone, and you can't shoot them in CA. I might be more frantic if there was an impending Ban of some sort.

No can do.

You can only buy a firearm across state lines by going through an FFL to do the transfer. The law allows you to physically go to a FFL in a different state and have a long gun transferred to you at his licensed premises provided the sale does not violate any local laws for him and it is legal for you to possess the firearm at your place of residence. As an AR is not legal at your place of residence, a FFL cannot legally transfer the firearm to you. As stated above, getting someone to buy the gun for you also violates the law.

IIRC there is a wavier for the military to bring guns into the state not on the DOJ list. I remember someone talking about this on one of the boards. I think all they did was call the DOJ and ask for the forms. This was for a AR-15 style weapon IIRC.

But then again I am getting old and have CRS.
