So I have an issue; I moved to California in October 2010 and put in for my new California drivers Lic; long story short I still don't have the liscense; yea it has been 6 months; I have called multiple times through the months threatened to sue and all they still won't mail me my identificationcard or drivers Lic; they say they are remaking them with new security features and mine has been made three times but didn't pass quality review; well I wouldn't mind except for the simple fact you can't my a firearm in California without an identification issued by California; so ya basically I can't buy any firearms because California isnt competent enough to make there own drivers liscense, so do I have a legal legit lawsuit against California for taking away my second amendment right by not issuing me my identification in a reasonable time frame, I'm seriously considering makin this a big deal, I havnt been able to by a firearm in half a year because of this, what do u guys think?

Maybe, but if you sue, given the normal pace of litigation, you'll get your license long before the lawsuit gets anywhere.

Litigation is a slow process. It's also an expensive one. Are you prepared to pay a lawyer $300 to $400 an hour (give or take) to pursue this?

The California DL situation is very badly messed up. The problem is that the vendor originally selected to produce the new, high-tech DLs hasn't been able to do the job right. It's anybody's guess when they'll get it sorted out.

You might want to check with the California Rifle and Pistol Association or the CalGuns Foundation to see if they are doing anything to monitor the situation or put pressure on the DMV to resolve the problem. But it would be very time consuming and expensive for one person to pursue this on his own.
 
Up until October 2010, CA-DMV merely was time consuming and had a lot of surly counter staff among the nice ones. Ordinarily one would get the license in the mail in a week or so (I don't recall ever getting one same-day).

Since then .... well, here's just one story.
 
The new CA DL/ID is to comply with the REAL ID Act.

A new $63 million computer system implemented in Oct 2010 has caused production delays and is the reason why CA DMV is slow to issuing out new DLs and IDs.

Currently, CA DMV says you should get your new CA DL/ID within 60-90 days.

If your CA DL/ID has expired and you are waiting for your new CA DL/ID to arrive, you can get a temporary license, via the CA DMV website, that is good for 90 days.

However, the temporary license is not valid for acquiring a firearm.

I believe the Calguns Foundation is aware of the situation and is currently forming a legal response to the issue.

If you're interested in litigation, the Calguns foundation is a great place to inquire. Head over to http://www.calguns.net to talk to them. They can give you a lot of information, and you'll be able to keep up to date with whether they already have a suit in the works.
 
Quiet pretty much said it, there have been news bits about how SLOW the DMV is with the new licenses, theoretically they are getting it together, but for now essentially the whole state is on hold over some company's inability to fulfill a contract to make IDs Lawsuit!- the ID company would be your target. I'm getting nervous about this myself, mine expires soon
 
I paid to renew mine in Nov '10. it was due to expire Jan 7, 2011. I took 9 weeks to get mine. The DMV said I was in the system and if pulled over by a LEO, I'd be OK.

You'd be amazed the things you need your license for. Cashing checks, presenting credit cards, flying, renting cars, buying firearms.

I carried my passport, but it wouldn't work for buying guns or renting cars.
