California one gun a month rule

Hi Hank,

If I understood correctly, you must wait one month and ten days. In other words, you buy a pistol and start DROS, only after the DROS period is complete may you begin the 30 day wait for the next one.

(edit) I believe the date would be May 10th.

New Cowboy Action shooters find this out the hard way. ;)

Have fun, keep safe.

My understanding is that you can't take delivery of two dealer-supplied guns inside of 30 days. So if you start the papers on a given day, you can start the papers on another 30 days later, 20 days after taking delivery of the first (if you picked the first up as soon as legally possible).

Huh. Now let's think here....what happens if you take more than 10 days on the first gun? You pick it up in 20 days instead of 10...owww my aching brain!

:banghead:

BUT there's a loophole. If you're buying a private-party gun legally through an FFL, the 30-day rule doesn't apply. I think that even covers consignment but I'm not certain.

When you DROS a gun in California, the dealer enters it into a computer system and a form prints out with the date and time the DROS was submitted. You are not allowed to DROS another handgun until 30 days (probably 30 24-hour periods to be exact) after the previous handgun DROS was submitted. I don't think it makes any difference when you actually pick them up (after 10 days, but not over 30 days after the particular gun was DROSed). This 30-day rule doesn't apply to long guns, and long gun purchases (which also require a DROS) don't impact when you can DROS or pick up handguns. At least this is my understanding. The CA DOJ's web site probably clarifies this.

If I bought a handgun April first (dros it the same day), when may I start the dros on the second handgun? April 21, so I can take delivery on my second handgun on May 1? May 1 or 2 so I can take delivery on the second handgun on May 12? I hope I made sense. BTW, thank you all for your responses.

Ok, here is how it would go in your situation:

You did the paperwork on your first handgun. You may pick it up 10 days (but not more than 30 days) after the DROS date. (The day you did the paperwork.)

If your last DROS was April 1st, you may not do another DROS on a handgun until May 1st. Therefore you may not take the second gun home until May 11th at the earliest.

...unless the 2nd, 3rd, 4th gun is a consignment sale, which is treated as a private-party to private-party sale, and is not covered by this law, which only covers guns from dealers. In that case you may take each gun home as it clears the 10 day period.

Of course, you'd think there would be an exception to the 10-day waiting period for CCW holders, since by definition we are must be already theoretically capable of killing someone at will, but NOOOOOO. :banghead: :banghead: :banghead:

PS: If you buy from a shop with an indoor range, you can go "visit" your guns and shoot them during the waiting period.
