Situation - friend now works in Virginia. I'm a CCW in Oklahoma. I'm getting conflicting answers from Vir. LE about me open-carrying in Virginia restaurants that serve alcohol, (no concealed carry in such places, unless owner or employee...), or open carrying at all. Some Vir LE say that ONLY Vir residents can open carry. Anyone know?

you can open carry.

anyone can open carry.

who was the law enforcement officer who stated otherwise? What department/city??? they don't know what they are talking about and we need to speak with their Chief to ensure the officers are properly educated.

Roanoak, Virginia is the area - I don't know if the LE was county, city, or state, or what - I was relayed this info from my friend who is opening a restaurant there, as I asked him to check for me for future vists.

I've recently been looking over VA open carry laws and from what I've seen, there's nothing saying that nonresidents can't open carry. From what I've found you just need to be 18 years or older (21 for concealed carry, of course) and legally able to possess/transfer/whatever firearms. But I'm now lawyer, of course.

Here's the page for Virginia laws that have to do with firearms (Title 18)

Of Title 18, I believe Chapters 4 and 7 might have the things you're looking for.

Concealed carry with a permit only … you do not have to be a resident to open carry. There are some places you can not conceal carry and some you can not carry at all. If a place serves alcohol you must open carry.
