Can police confiscate all of your weapons?

So I have a brother that told me that there was a guy at work that got into a gun fight, he shot the first guy two in the chest and one time in the head, the second perp was the perp’s girlfriend who saw everything freaked out and was overwhelmed with emotions and walked to the perp’s side cried and decided to pick his pistol and shoot back, the guy ducked behind a car put two shots into her and she went down. Now the shooting was justified. Here’s where it gets weird. The cops got a warrant and confiscated ALL of his weapons…now why would they confiscate all of his weapons for? For what reasons? By the way the dude’s black but I seriously doubt that have to do with anything, or at least I hope not…and the apartment landlord wanted to kick him out after the shooting! I thought that was funny and could the landlord kick you out for a justified shooting?? And can the cops confiscate ALL of your weapons?? I thought they’re suppose to take only the guns that was involve at the crime scene?? Or an I missing something here??

Well, if the shooter took off and ran home, the police don't really know which gun was used yet.
If the shooter stayed at the scene, the confiscation of his remaining guns may have been because he is suspected of committing a crime.




Or an I missing something here??

maybe planning charges? maybe he was in illegal possesion, maybe the gun he used was reported stolen in 1966, and rang up. Maybe His cousin is in the department and thinks he's suicidal? Lots of legit reasons are possible. As far as the landlord, I have seen lease contract that forbid firearms. DSHS is famous for that.

The dude was there, he didn’t ran away, the perp that was shot was his neighbor’s cousin. They both lived in the same apartment complex. The cousin asked the guy if he was cool with him cause he didn’t want any “beef” after he got back from interrogation. All the evidence point to him that it was a justified shooting.(note the past tense: justified, not justify) It is in the “ghetto” area of Tulsa. North Tulsa I believe. Been through that part of town sure as hell don’t feel safe when I have to go there or drive past it. The “good guy” has armed security guard experience. And going by the story of what my brother told me, I believe it. The good guy definitely has that mind set that was prepared to use deadly force. He came back to work like nothing happened… I don’t think I could come back to work after getting into a gunfight. He also warned the perp’s girlfriend, “Don’t do it!” As she picked up the pistol crying, emotionally overloaded and as she raised the pistol at him and started firing.(note that our good guy actually gave her time to stop but unfortunately her emotions got the best of her, who wouldn’t right?)
 
The bad guy was probably having a bad day. And outta of the blue, “I’m going to kill everybody!!” The bad guy went into his apartment took out his pistol and racked his pistol.(a very distinctive sound that us gun shooter would recognize at any time of the day) And the good guy happened to be there as he was walking out of his apartment, he saw the threat and knowing his wife and kid was next door to theirs only did the most sensible thing any caring loving man would do. Protect his family… hopefully he get the heck outta that apartment, especially in the boonies!!!!
 
And as far as I know, the first perp didn’t let out a shot. Guess he didn’t see it coming.(or maybe that’s what he wanted…) I’m still baffled…so I guess if the cops are going to confiscate all the weapons you have then buying a second pistol as a backup would be pretty much pointless….might as well get a few more blackpowder then since it ain’t consider a “firearm”!!! :D:D:D:rofl:

If he was that concerned he would not initiate a gunfight, but would get his family to a safe place. Sounds like he got a bit too "Rambo" for the situation and it may cost him dearly. Keep in mind, you are "not a cop", and anything you do on the civilian side has many unforeseen circumstances. He took a life, he will be under extreme scrutiny. Having a gun and an attitude does not make you an automatic "good guy"!

Since we don't really know anything about what happened other than third hand, it's a bit early to try to be drawing conclusions.
Would law enforcement need to charge you with a crime to confiscate your property?
No. If your property is considered evidence in an investigation, it can be confiscated even if you have done nothing wrong.

I posted about a home invasion where the homeowner and his wife were both hurt badly but managed to fight off the invader who died from his wounds. At least some of their firearms were confiscated and held for 3 years even though no charges were ever brought against them.

If there's obvious evidence of a crime having being committed (e.g. bodies on the ground), they don't need to wait for a warrant to start confiscating evidence.

We really need some better information about what happened. It's kind of pointless to try to build a case for or against what the police might have done based on the thirdhand account of what might have happened.

With the information you have, can you find anything online relating to the crime? A double homicide should have at least made the local news...
