Can the BATF search your house if you have a Class III weapon?

I was told that if you have a class III weapon that the ATF can search your home for the gun whenever they want, that you have to have it available for inspection whenever asked and that you are also not allowed to be more then 50 miles from the guns location without leaving it secured with a class III dealer?

Coming from the person it came from, I doubt this is true... but still... knowing some of the laws I see out there I wonder.

I've never heard that but I have heard that with the new regulations to get a new FFL, that if you were grandfathered in and your FFL address is your home address that they can search your residence up to three times a year.

I have one friend that several full auto weapons and another that has a few supressors and neither of them have mentioned anything about a search for such items and they're both the sort to carefully read everything.

The Arlington County VA, Sheriff's department got themselves in trouble a few years ago, for trying to include mandatory home inspections as part of the Class III process. I don' t know if it was a one time thing, or if they just wanted an open door.

Any rate, it got knocked down in the State Supreme Court, thanks to the VCDL, if I recall correctly.

Don't beleive everything you hear.

I looked into this throughly a few months back when I was thinking of getting a supressor. The info I got was from a local class 3 dealer who told me that the atf DOES NOT have a right to search your home at any time simply because you have a class 3 weapon/item. When you obtain a class 3 permit your are simply complying with law it is a one time fee that is never paid again unless you sell or transfer the item. atf can not ask you to produce the item either its simply the law by abiding by the nfa firearms act you do not suject yourself to routine searchs,for the item or anything else.

the fact is that getting a class 3 item doesn't let atf search your house no more then haveing a normal pistol. If your are a class 3 dealer that is differant altogether as far not being more then so many miles away from the class 3 item its simply bullsh*t. Find a class 3 dealer in you area and he should have a handy little booklet outlining all rules for class 3 it's very informitive. I hope this helps you out.

megatronrules, is correct. If you own a NFA weapon, ATF can ask to see your paperwork to verify you have paid the federal transfer tax. They cannot enter and search your home without a search warrant.

The 50 mile rule is complete fiction.

Speaking of no warrants

I saw one of those go down on local television last week. The cops "thought nobody was home". Two wounded cops and two dead "ex-convicts". There's actually a lot more to this than meets the eye or has been mentioned in the media though. For example one of the men killed was wearing an electronic tether and it was due to be removed that day (probably why they thought nobody was home, late for his appointment?). The news said they don't believe these guys knew they were shooting at cops. No mention of contraband found.


I was especially fascinated watching the police drag these people through the front yard by their heels as though they were animals bagged in a hunt.

ANYBODY sneaking around in somebody elses home unannounced and uninvited is a criminal. How does it matter that they can produce a badge after the bullets stop flying?

If you believe what you said about anybody who is uninvited being a criminal you obviously don't know much about the law.

I'll give you one glaring example - game wardens in this state can go anywhere and don't need a warrant.

And another. Ever heard of probable cause in the case of the police?
