carrying around an apartment complex

i was wondering
if you do NOT have a CHL are you legally allowed to carry a concealed weapon within your apartment complex?

If you live in WA, you can open carry without a permit almost anywhere, apartment complex included.

Why would you want to?

I know there is the possiblity of no CHL but if you live there you may make yourself a target for breakins and if you don't live there, the sheep may get nervous seeing someone they don't recognize packing heat. Just a thought.

In answer to your question I would doubt its legal, but it really depends on where you live also, that's helpful info to provide if you want an accurate answer to questions like this. In your apartment you are safe, once you step outside your front door you are probably breaking the law.

Apartment complexes might be somewhat of a "grey area"....

Here's a portion of the NC concealed carry law:

(7) any premises, except state owned rest areas or stops along the highways, where notice that carrying a concealed handgun is prohibited by the posting of a conspicuous notice or statement by the person in legal possession or control
of the premises.

A lawyer friend of mine explained it to me like this....

If a business owner (any business, including apartments and motels) posts a sign declaring that firearms are prohibited, then even with a CCW permit you cannot legally carry on that specific property.

And if you come to NC you will notice that most businesses have signs on their doors prohibiting firearms.

So, if your laws are similar, then I would check and see if the apartment management has posted any signs that prohibit firearms, or have it written in to the lease agreement.

In CA you can carry in your apartment but NOT in the common area unless you are an Owner carrying @ your business property. At your residence, home, you can carry wherever you want as long as you are on your property.

If you live in one of the free states where concealed carry is not prohibited, do yourself a huge favor and get your license!

Not only will it keep you legal . . . within your state's unique laws of concealed carry, but you'll also be making a statement to the politicians that yet another citizen deems it important to exercise the right to carry. The more CCW folks on the books, the stronger our cause appears!

As to toting around outside in an apartment complex . . . I highly doubt you'd be legal without a CCW permit. Instead, if you get caught, you may end up a convicted felon for your mistake (of not getting a license).

In an apt complex, anything outside the door is a common area. In other words, it is shared property, so the quick answer is NO. If you own your own property, and can legally copntrol your area, then normally you are ok, outside of city limits. Law or no law, if a cop sees you outside in your yard with a shotty, expect to see a lot of cars show up fast.

As said, depends on your locale. I wonder if you're the same guy that posted on TexasCHLForum. At any rate, in Texas, you can basically carry on your property or whatever is attached to your property. So your balcony, an attached garage, etc. You would need a CHL in order to carry on any common areas accessible by others. So basically, walkways, streets, entrance foyers, etc.

Can an apartment complex post the whole place off limits? Or at least the common areas?

If you have a CCW and there is no postings, I would assume that it would be ok. But, based on the laws of the state you are in, they may be able to post the whole property.

Also, if you live there, you may have something in your lease that you signed sayiong not to carry, etc. I am pretty sure that once you signed that, it is a valid no no.

This used to be the case in TX i beleive, but those no handguns signs do not count anymore. The only two signs that can keep a texas CHL holder from carrying on is the 30.06 statute sign and the 51% sign.
