CCW question?

My buddy is filling out his CCW application in the state of Wisconsin. Question #5 asks if you've ever been convicted of a misdemeanor or domestic dispute. Does a speeding ticket count as a misdemeanor? If so, will Wisconsin reject his application for answering yes?

He said it does not specify what class of misdemeanor.

I think that questions refers to only domestic dispute and not misdemeanors such as traffic violations.. They are trying to determine if you have violent tendencies I assume.. At least that is how the CCW permit application here in NC was. Ask him to reread the question carefully and see if he comprehends it a little differently now... Hope this helps..

Ya I wouldn't think they care about a speeding ticket. I advised him to just check no. I checked my own CCW paperwork (different state) and didn't see the same question.

Exact question on his form reads:

Have you ever been convicted of a misdemeanor crime or domestic violence?

In the Wisconsin case, the question is simple:

7. Are you currently free on bond or bail for a pending felony or misdemeanor offense,
or as a witness, where the court has ordered you not to possess a dangerous weapon?

That's pretty cut and dry. If you had to have bond posted for a misdemeanor -- and you are still out on that bond pending adjudication -- the answer is "YES"

im most states it says specifically that traffic violations dont count. this is from virginias, but im pretty sure most states are the same " Persons Not Qualified To Obtain a Permit: An individual who has been convicted of two or more misdemeanors within the five-year period immediately preceding the application, if one of the misdemeanors was a Class 1 misdemeanor, but the judge shall have the discretion to deny a permit for two or more misdemeanors that are not Class 1. Traffic infractions or reckless driving shall not be considered for purposes of this disqualification." once i again, i know this is virginia, but odds are it should be treated the same. but i know for a fact that in WI, speeding tickets are infractions, not misdemeanors

Absolutely true. And, a conviction for a misdemeanor crime OF domestic violence is a Federal prohibition against even possessing firearms anyway.
