Just got back from the gunstore/range. While talking with the manager he informed me that twice in the last 10 days people who purchased 2 handguns at the same time( Requiring BATF notification ) waited 72 hours and then took them home had a visit from Chicago PD the next morning with a search warrant to look for the guns.

Do not know for sure but it is possible/probable that this is CAGE i.e. Chicago Area Gun Enforcement at work again.

I could never figure out why someone would buy more than one handgun at a time considering the number of flags that get raised by that.:confused:

If anyone knows of the specifics

of one of these cases they need to get this info to the NRA.

A search warrant has to be based on some information regarding wrong doing. Unless you have an FFL where you wave that right (the reason I gave up my FFL).

Sounds to me like a "fishing expedition": the Chicago PD want to make sure that the guns are actually in the possession of the purchaser, and haven't been passed on to others.

This immediately raises the question: on what grounds was the search warrant issued? You can't get a warrant without a detailed reason for its issue. If the reason is "to ensure that no crime has been committed by a straw purchase", IMHO, that reason is not legal. They're not looking for evidence that a crime has been committed: they're looking for evidence that a crime has not been committed. I'd challenge this one in court immediately, and sue for damages.
 
My understanding is that they can get the search warrant because it is impossible to register a handgun ( and many long guns ) in Chicago unless you are
A LEO
B Armed private security
C Alderman i.e. City Council
D Owned the same firearm and lived continuosly in the city since the 80's (85? Not sure ) and have never forgotten or been late to register the handgun.

What appears to be happening is people with a Chicago adress on their FOID )Firearms Owner Identification can legally buy a handgun but they cannot take it into the city legally. Daley :)barf: :cuss: :fire: :banghead: ) has tried many times to make it illeagle to sell a handgun to anyone who has a Chicago city adress on their FOID. So far he has not been succesfull.

LEO's please tell me would a judge issue a warrant if the persons legal address was in Chicago (Illeagle to posses handguns at all in Chicago) and they had just purchased two or more handguns. Would that be enough for probable cause ?

That's about it: The law does not have to be just, or even constitutional, to get a search warrant. You merely have to demonstrate to a judge that there's a fair probablity of finding evidence of a crime if the search is undertaken. And, objectively, if you buy something which it's illegal to possess where you live, then you've given them grounds for a search warrant, even if you could legally store it elsewhere.

Mind you, if I owned a gun store anywhere within a couple hundred miles of Chicago, I'd explain to anybody from Chicago who tried to buy two guns what they were letting themselves in for, before I processed the sale.
 
Every government has henchmen. The problem is that the leadership in IL has given them bad laws to enforce.

What blows my mind is the sheer numberof military weapons manufacturers in IL. You would think they would be more receptive to their own citizens enriching the local economy.

Chicago really needs to be hit by a natural disaster.

Violent crime, homicides up in Chicago

In January, reports of violent crime rose by more than 13 percent over last year, and homicides rose by 40 percent, Chicago police said Friday.

There were 28 murders in January, up from 20 in January 2005. Over the last two years, murders have declined by 25 percent in Chicago, according to police statistics.

Although some months in past years have shown an increase in murders over the year before, the January numbers concern police officials. January was the first month in more than two years in which the overall rate of crime increased.

But Deputy Supt. Charles Williams said the increases were relatively small, and police expect the numbers to decline as the year progresses.

Aggravated batteries, which include non-fatal shootings, rose 7 percent, and robberies rose by 13 percent, according to police. Burglaries and thefts were up about 10 percent, and motor vehicle thefts increased more than 17 percent.

Arson was up 41.7 percent. Reports of criminal sexual assaults were down 17.6 percent, according to police.

Mr. Smith, who has a Chicago address on his FOID card and driver’s license goes to an area gun dealer and buys a handgun. While it is illegal to have this handgun within his residence in Chicago, it appears that the goons don’t come calling.

Ms. Jones, who also has a Chicago address, does exactly the same, but buys two rather then one handgun for whatever reasons she might have. This is reported by the dealer to the BATF&E, and shortly thereafter the goons do come with a search warrant to check on what Ms. Jones might be up too.

Obviously in the first instance nothing happens because the authorities in Chicago are unaware of Mr. Smith’s purchase. However in the second one the sale is reported to the BATF&E who quickly go and tattle to the police in Chicago.

In my view, anyone that lives in Chicago and wants to own a handgun should move out of Daley’s Dictatorship and establish residence somewhere in the free world. However if they can’t or won’t they should be made aware that the BATF&E is in bed with Daley’s Goon Squad, and therefore buy as many guns as they want, but be careful not to take delivery of more then one without at least a weeks time between getting the next one.

To do otherwise is obviously asking for trouble, but the potential is one they ask for by simply living where they do. This is unfortunate, but it’s unlikely that Chicago is going to change – at least for the better.

Man charged with 276 gun counts

A Southwest Side man was charged Thursday with 276 counts of possession of unregistered firearms, police said.

James R. Patrick, 63, was arrested Wednesday morning after police found about 300 handguns, shotguns and rifles in his home in the 3700 block of West 62nd Place, plus several thousand rounds of ammunition.

The charges against Patrick are misdemeanors, Officer Kristina Schuler said. Of the counts, some are for failure to register a firearm, some are for possession of unregisterable firearms and others are for possession of certain long guns not registered before 1982, she said. Each charge carries a penalty of up to $500 or imprisonment of up to 90 days, according to city ordinances.

Eric Ellis, of the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives, said ATF agents are continuing to investigate how Patrick obtained the weapons and what he planned to do with them. In addition, ballistics tests will be performed to determine if any of the weapons have been used in a crime.

Of particular interest to federal authorities, he said, was an AR-15 rifle that police believe Patrick was converting from semi-automatic to automatic, potentially a violation of federal law. Officers found a military manual in Patrick's house that included instructions on the modification.

Also found was a pistol designed to fire shotgun shells, which is being sent for further study at the ATF technology lab to determine if it violates federal statutes, Ellis said.

They left out the part about him being a man and thus equipped he must have been intending to rape someone ....:banghead:
 
So the man has a book that talks about to how to do something illegal. Is that illegal? There had better be proof he was doing it. And the man has a pistol that fires shotgun shells? (Dont some flare guns have that capability?)

Its good to know they know whats illegal and what isnt? You know their crime lab is really working hard on this one.

I bet they didnt send the 3 automatic weapons that those police officers with to the crime lab and all that jazz.

THis is ridiculous.
 
The fact that Chicago is allowed to legislate for the rest of the state angers me to no end. There would be no FOID, no registry, no ban on future handgun sales, and no goon squad going after citizens practicing they're inherent civil rights.

Chicago is a little piece of NYC in the midwest, and I hate it.

Mordec, I couldnt agree with you more! Try living here, and watching Daley (Chicago's mayor, who reminds me of a snot-nosed spoiled kid ) and Blagoyovich (IL Governor) constantly spout twisted statistics, and try to tell us how we should just hand all our guns in, and Illinois will suddenly be a friendly and loving state! God, I pray both of these IDIOTS get defeated next election. Just because the extreme northeast corner of the state is a crime ridden sesspool, the rest of the state shouldn't have to give up our rights. They should go live in California.

Because it's their right as an American.

The fact that Chicago is rapidly turning into a very scary hybrid nanny/police state with an unhealthy sense of denial is irrelevant.
