Clerk shoots first

That happens quite often in Texas, at least one robber a week bites the dust here in Houston, unfortunately an equal number of unarmed innocents die too.I guess they are too busy smoking crack to realize that, many convenience store clerks are armed and generally the most they will get is maybe $50...

Nice video, showing how guns are used for a good purpose. Well anyway who has interviewed this Anti: "Oh, it could have been the other way around" - yep if the woman would have been unarmed it could, this way it wasn't - fool!

The saddest part of this incident was that it ever made it to a grand jury in the first place, especially with the state/district attorney having this video

In Texas, You will see a Grand Jury if you kill someone. No matter what. With a tape like this, you are more likely to get very firm instructions from the Prosecutor to No Bill. Not sure about other states.

Ridiculous

One it was utterly ridiculous to put this woman through a grand jury after having to take a life in CLEAR SELF DEFENSE!! Two, I could not believe the guy saying its a bad idea for people to have guns when being robbed at gunpoint:banghead: I guess you are just supposed to leave it up to them to decide whether to kill you or not??:what: *Note all armed robbers are nice people who would never hurt a fly just give them what they want and you will all be friends.:scrutiny:

That is just how Texas law works, every self defense case goes before the county grand jury, there is always one in session in every county in Texas.The women didn't have to appear as long as the DA recommended no charges be filed.Just a formality that has to be done!

Um, no. Every self defense case does not go before the grand jury. Every homicide does, including those that are self defense.

---------

For those folks who want to know if 5 shots are enough...sometimes just enough, but of course, she hit the bad guy all 5 times.

I would be banned from this site FOREVER if I was to post what I was saying to the dipshi, uh dipstick, who was spouting all that hooey about "escalation" and "the other way around", etc.

I think I might be able to speculate on this.

While in most states and in most instances the grand jury just affirms or denies a prosecutor's request for an indictment, in some instances grand juries can start investigating on their own, and they may be on the grand jury for months at a time. So perhaps what happened here was that the grand jury felt obliged to at least take a look at the video after learning of a killing.

The good thing is that if the grand jury does not indict you, especially in a case like this, it's not like you've lost anything. You didn't even have to hire an attorney. Acquittals are nice, but they cost money. Failure to indict is a lot cheaper.

Law isn't completely unreasonable. ;)

I'm not sure where pro-gun people get off saying that having a firearm does not escalate violence. Of course it does. Inherently, having a weapon present increases the possibility of it being used. If it isn't there, it can't be used, and this, no violence.

It's not a difficult concept to grasp, people.

It's the same as how you carry a concealed pistol. Eventually, you might be in a situation where you have every legal right to use it. Ta-dah! Violence occurs. If you didn't carry, it wouldn't.

Violence is violence even if it's self-defense.

What escalation? There was zero, none whatsoever. It was an equal footing of force, Bad guy lost as it should be.

I'm glad the clerk made it out of the situation okay. I wonder what her therapy bills are like. O.O
Reading too much Ayoob are we? Two people I know who have killed in similar conditions have not had 'Therapy Problems' . Neither wanted it to happen but both are content with the results. Pharmacist said "I gotta get a bigger gun"
after bad guy made it acrossed the street with two .38's in him.

The robber should get a Darwin Award.

She opened fire on him (with a shot that missed him) as she ducked down behind the counter. Rather than turning and running away, he decided it would be a good idea to try and climb over the counter after her.

I say forget the Dawin Award... he deserves a Carlos Mencia "Dee Dee Dee" award.

I know you aren't implying that bad people never use violence against unarmed people? :scrutiny:

Violence occurs whether one carries or not ... the problem is that too many people can't differentiate between good violence and bad violence (which I believe is the point you were trying to make).

guys, please post text, as the site is blocked on my network.
Video transcript

<shows a quadranted screen B&W security cam>

Narrator: Hundreds of robberies do end in death each year and sometimes these grim outcomes are caught on tape.

<switches to a single screen>

Narrator: At this liquor store in Dallas, Texas a masked robber enters wasting little time before drawing his gun.

<shows man entering store and walking directly to counter. Holds gun in both hands pointed at clerk who ducks behind counter.>

<switches to "talking suit" who says (with a lisp)>

Suit: I don't advise convenience stores to keep weapons on the premises because that just escalates the violence.

<back to security cam with robber approaching counter>

Narrator: But this clerk was recently robbed and has a gun of her own.

<Robber yells at female clerk who is behind counter. Clerk responds with a gunshot to which the robber says "Ungh!" Doesn't seem like he could have been hit at this point but maybe>

Narrator: The clerk fires the first shot which fails to deter the suspect.

<robber stands right at counter talking to clerk who is behind counter at a point where there is a large display of some sort so the robber can't just lean over and see her. You can hear the robber say something that sounds like "...blow your head off!">

<back to lisping talking suit.>

Suit: He's highly excited at that point--adrenalin is running very high.

<narrator resumes and video shows robber climbing counter.>

Narrator: She keeps firing.

<clerk fires two or three shots (one may be the robber firing--it sounds different) at which point robber pushes over display on top of clerk.>

<clerk fires several more times (I think a total of six shots) and robber folds up and falls off counter (away from clerk)>

Narrator: Four more rounds--accurately placed.

<clerk gets up from behind counter and walks around the end of the counter. robber is moving around on the floor weakly--clerk says something unintelligible in a stressed voice.>

Narrator: He briefly rises to his knees but slumps back down--fatally wounded.

<clerk leaves scene--apparently exits store>

Narrator: Somehow this clerk has survived! And killed her assailant in the process.

<Back to lisping talking suit>

Suit: It could have been the other way around--very easily--and the clerk could have been shot and killed.

<Back to narrator & replay of the video starting with the robber climbing onto the counter>

Narrator: In this case the video serves as a vital eyewitness when the grand jury rules that the clerk killed the suspect in self-defense.

<video ends>

The robber was completely undeterred by the shots fired at him until he was no longer able to function. Scary person and IMO it's a very good thing that the clerk was armed and willing to shoot.

What escalation? There was zero, none whatsoever. It was an equal footing of force, Bad guy lost as it should be

Actually, there was. It occurred the moment the bad guy threatened the use of deadly force by pulling his gun. Unfortunately for him, he forfeited his life on a wrong path. One less scumbag on the streets. Give that woman a medal.

I think the moronic escalation point being made is that the clerk simply used her handgun as a projectile dispensing weapon whereas the robber simply used his as a prop. So, there was an escalation of projected force from threat to application, but this is not a bad thing at all. The clerk precluded allowing the robber from being able to escalate from felonious threat to application of lethal force against HER.

I don't understand why there is concern over escalating force. It is almost like somebody thinks it is somehow unfair or more dangerous. Given the unfairness of the attempted robbery and lethal threat of the robber, the response by the clerk was fair, plus being legally justified. The clerk went home from her legal job to her family. The robber did not go home from his illegal job.

MA residents have been assimilated.

When will America invade Massachusetts and give us liberty?

On second thought liberators coming to this state will probably receive the same reception the US received in Iraq.

"Somehow this clerk has survived." That's the point.

Somehow, brain-dead dopes are continuously given responsibilities far in excess of their intelligence. News Reporters, for example.

The crook was and the commentator is retarded. I was involved in discussion with a co-worker about this sort of thing and she actually agrees with the commentator's POV. Guns should be outlawed, according to her. I told her a few stories of females that have used a weapon in self-defense. She is glad that someone could protect themself, but would still ban guns. Some people are hopelessly stupid. In this case, it is simply unbelievable that someone could say that someone should not have a gun in a store when the person that has it uses it to defend their own life, successfully, I might add. How illogical can one be? These are the same idiots that would have us all disarmed in a heartbeat. I almost can't even tolerate these stupid idiots any longer.
