'Rambos in the Restaurant' Bill

(WSB Radio) -- A Marietta state representative is proposing legislation that would allow anyone with a concealed weapons permit to take a handgun inside most Georgia restaurants.
Supporters say it embraces constitutional freedoms. Critics call it the "Rambos in the restaurant" bill.

Rep. Bobby Franklin has introduced similar proposals in the past.

"What if someone comes to Atlanta to stay at the Ritz-Carlton, and they have to walk a couple of blocks to a restaurant?" Franklin told the Atlanta Journal Constitution. "They'd like to be able to carry that gun in downtown Atlanta at night. Right now, even if they have a permit and have passed the background checks, they can't."

Franklin's proposal, which would apply to any restaurant that generates more than 50 percent of its income from food.

For years, the state has banned weapons at restaurants that serve alcohol, at football games, in churches and at other public gatherings.

Hope it works out. We're fighting this crap in SC right now with the Grass Roots pushing hard for it. Face it, evey rest. sells alcohol except Micky D's, Hardees and BK! Not everyone with CWP's drinks, why are these people being punished! Myself? I love a big 32oz. draft XX when I go out for fajitas!

We've been consuming liquid bread while packing our big, ol' hawlaigs for decades up here in Yankeeland. So, where's all the blood in the streets on Friday night? Do the representatives who would deny this reform not trust their fellow citizens? Are Georgians somehow different than Hoosiers and the mere sight of liquid bread will turn them into Rambos? :rolleyes:

When I was a 20-something cop in SC, I could carry off-duty, anywhere in the state; even have a brewski, if I so desired. Naturally, if I had been stupid enough to become intoxicated, and had become involved in either a ND or an intentional shooting situation, well, .....

Now that I've reached age 50 (or so) with a perfectly clean criminal record and no addictions or drug/alcohol habit, I am prohibited from maintaining an armed defensive capability if I take my wife to a nice restaurant.

I am NOT bashing LEOs; you'd look long & hard to find a bigger POlice booster than me. However, I do believe that, if the possibility of alcohol-induced gunplay is the real issue, the prohibition should apply across-the-board; only on-duty LEOs inside their jurisdictions (e.g. plainclothesed, investigative, undercover, or responding to a call) should be exempt.

Oh, and maybe postal workers :what: . JUST KIDDIN', Folks!
 
This is the first I've heard about this bill. Living in Georgia, I think this is a very good thing and am excited. I hope this makes it through.
 
I think a protest could be put together ... just a bunch of people standing outside the legislature chanting "Luby's Diner" over and over again.
 
I don't do it but I have known several GA residents who carry their firearms into restaurants. As a matter of fact I had a off the clock LEO friend open carry a HG into a Sonny's BBQ and no one said a thing or even gave him a second look. He was dressed down and had nothing identifying him as a LEO. He even walking in and out of the restaurant and up and down the Ilse past other customers and no one said a thing. I guess the rule of 'don't ask don't tell' is the one way to deal with the situation.

I don't think Sonny's sells alcohol (at least, I think not the one in my town) so it's not a prohibited place. The current law reads that you can't carry in any location that serves alcohol. This stops you from carrying into places like Applebee's or Chili's that serve mainly food but also serves alcoholic drinks.

The actual wording of the law is "establishments at which alcoholic beverages are sold for consumption on the premises".

He came up with a scenario as to why it shouldn't be allowed.
A CCW holder has had problems at home with the wife and family, lost his job that day, and general other stress. He gets to the Burger King/whatever and places an order... EEGADS he forgot his wallet, the manager comes out and starts fussing at him and the chashier. Eventually the CCW holder snaps and shoots the manager.

I voted yes.

Ask your "buddy" exactly what would keep a person from illegally carry a gun into the restaurant and then ...

Also ask him to cite an example where a CCW holder did indeed do what he described. Arizona for example, is full of license holders, has been for over a decade, and we haven't had anyone shot by a CCW in a restaurant yet.
 
Oh, I hit him with all kinds of logic, but that didn't phase him.
I don't think his position was more of a "OMG THEY SHOULDN'T BE ABLE 2!!" but more of a "I think this is a good reason not to."
Not really 100% against it...but he finds reasons not to allow it.
I think the chance of a CCW (who are leaps and bounds responsible) snapping and shooting someone in a resturaunt is microscopic compared to the chance of a madman using any kind of weapon to kill people in a resturaunt.
 
I can't believe no one has made mention of the GFODL bill that the Georgia Firearms Owners Defense League is trying to introduce. Yes, ladies and gents there is a grassroots organization in the great state of GA that is fighting for your second amendment rights. While HB193 is a good bill, it is NOT enough. You think "public gatherings" are the only places off limits to citizens with a firearms license? Try WMA's, State Parks, Stone Mountain Park, Airport property, MARTA, or any other bus or rail vehicle, interstate rest stops, even having your gun in your car not on your person in one of these places is still a violation of law. Even having your pistol in a parking area in your car or on your person in any one of these places, public gatherings, or even if a few people are congregating (i.e. tailgate party, rally) in the parking lot of a public place - you are still in violation of the law. This is just not speculation, it is FACT. There are caselaws where the convictions were upheld by the court of appeals of people arrested and charged in the situations described above.

Georgia has some of the most restrictive and vague firearm laws in the nation. And what is worst of all, not all of these laws are contained title 16 chapter 11 of the GA criminal code. They are sporadic at best. Laws restricting the carrying of firearms can also be found in titles 12, 27, and 42 of the GA code.

The GFODL bill was composed by LEO's, Attorneys, and ardent defenders of the RKBA. It covers every single aspect of firearm possession and carrying addressed in the GA code and truely gives firearm license holders the "right to carry". Anyone who is serious about CCW reform in GA should go over the GFODL and print out the copy of the propsed bill and email/fax immediately to their representative DEMANDING their support. We can make this happen, but only if we have everyone pitching in and helping. It all or nothing.
