Constructive Intent Questions RE:AR15 Pistols????

So I was at the gunshow this weekend and they had a pretty nifty looking AR15 pistol, not something I would buy but pretty cool none the less. Anyway let's just say that I purchased said AR15 pistol which is for all intentents and purposes just a really short upper on a non-stocked lower.

So now the question. I bring home said pistol and it share's a safe with my other two standard AR15 rifles. Now technically is that not constructive intent, as I could technically take the shorty upper and install it on one of the rifle lowers, in effect creating an unregistered SBR?

Now I would never do this, nor am I advocating this. I follow the laws to the letter no matter how stupid they are. I was just curious. So do any of you folks with those AR15 pistols also have AR15 rifles and have you ever thought about this angle. The BATF has, IMO, declared constructive intent for less.

Wow my first post that seems to have rcvd' a collective huh? :D

Well normally I would write the BATFE to sate my curiosity but in this case I figure I won't give them any more ideas.

I dont see n e thing wrong with it. You can own an UZI pistol and an UZI rifle and keep then in the same cubby. As long as the pistol isnt diassembled or any thing i think youll be alright. I think the pistol lowers are registered to the upper if im not mistaken.....am I??? :scrutiny:
 
I believe I had this discussion with DPMS at the SHOT show. IIRC the pins are located in slightly different places, precluding the mating of rifle and pistol parts.
 
IANAL, but the ruling in United States vs. Thompson/Center Arms seems to indicate that if you have a legal way of using all the parts, you can't be convicted of constructive intent.

Now if you had an AR rifle with a rifle upper and a short pistol/SBR upper, but no AR pistol lower, that would probably be enough to be prosecuted for constructive intent.
 
Yeah, What Steve said. You won't be about to join the uppers and lower(I assume you got a Carbon15 or the Bushmaster Carbon)

I shot an ar15 pistol quite a bit and find then absolutely painful to use. Even with ear plugs on, the blast is just terrible. But they are really sweet anyhow....good score!
