Does purchasing 2 C&R handguns in 5 day period put you on the ATF list?

Okay, here's a statement followed by a question:

I understand that purchasing 2+ handguns from an FFL in a 5 business day period is required to be reported to the ATF by the FFL seller.

Does the same apply say, if a C&R holder orders 2+ C&R handguns from a dealer?
 
No.
Any more than a Type 01 FFL ordering more than 2 handguns from a distributor.
And there is no "ATF List." The sale is reported to ATF the same day. I am pretty sure they make a database of those guns btw.
 
I know that the 5 day (or was it 3 day) report rule was true in the 1970s I don't believe ti is still true but don't know for sure. Since the advent of the NICS phone call i doubt it but realistically speaking you are probably on some government list if you buy any firearm from a FFL dealer. If you but more than 2 a month you are probably on double secret probation!!!!!!

§ 478.126a Reporting multiple sales or other disposition of pistols and revolvers.

Each licensee shall prepare a report of multiple sales or other disposition whenever the licensee sells or otherwise disposes of, at one time or during any five consecutive business days, two or more pistols, or revolvers, or any combination of pistols and revolvers totaling two or more, to an unlicensed person

Still current, still enforced, only applies to sales or transfers to unlicensed persons. Where does the report go?

Not later than the close of business on the day that the multiple sale or other disposition occurs, the licensee shall forward two copies of Form 3310.4 to the ATF office specified thereon and one copy to the State police or to the local law enforcement agency in which the sale or other disposition took place.
 
Brings up an interesting scenario I'll have to check on... I am a licensed person (C&R), but 478.126a doesn't say the exemption is only when I purchase C&R eligible handguns.
 
Assume you are a C&R holder.

Here is Missouri purchasing 2 or more handguns on the same day the FFL is required to let the local sheriff know. The odds are the local sheriff will not even care.

AFAIK if you buy 2 C&R handguns there is no need as the pistols are being transferred to an FFL (C&R 03) and not just any Joe Blow.

Best bet is to call your local BATFE branch and ask them. I have asked questions before and the agents seem to be courteous when treated courteously. Theorizing about the correct rules is a mistake.
 
I went thru this a couple of weeks ago. I ordered some handguns thru gunbroker.com and had them shipped to a ffl dealer who informed me that they had to report purchases of over two handguns in a 5 working day period. Simply don't fill out the papers on the same day. Pick one or two up one week and a couple of the others a week later.

Well that is certainly not the first time that an FFL dealer has distributed bogus information. Read the regulation quoted above. It's not over two handguns in a 5 day working period. The regulation states TWO OR MORE.
