No need to pile on; just recognize and acknowledge that Mr. Jadlowski (the shooter) is a criminal who willfully engaged in a criminal act (i.e. hunting deer after sunset) with deadly consequences.

Responsible gun ownership includes following the laws regarding the possession and use of those guns. There is no room to excuse, justify or minimize Mr. Jadlowski's actions and he should be prosecuted to the fullest extent of the law to remind other people that the laws are not suggestions but exist for a purpose.

Happened in one of the town's that I hunt.
And at the very least he should be charged with manslaughter and reckless endangerment [ NYS laws are what they are ].
As well as all the game law violations AND never EVER be allowed to own a gun or hunting license [ no bow either ].
When he gets out of prison.
 
A very sad tradgedy, indeed..... Considering the time frame after sunset when legal hunting ends this was done in little to no light when no one should even consider taking a shot at what they believe is game. 40 min. after sunset in western NY state this time of year it's DARK.
 
Though I didn't click on it, I did see another headline today regarding another "hunter" who shot, thinking it was a deer, a.... pickup truck. Must have had antlers on the hood.
 
All the trouble he is in for a stupid deer..... How you ever mistake a person for a deer is beyond me. Even if the person is dressed in brown Carhartt coveralls. You always make sure of your target or you don’t take the shot. But I’ve been shot at walking through the woods during rifle season. Scary stuff. But this lady was in a FIELD.
 
The reason for no hunting after sundown laws was specifically to prevent mistakes like this.
And rule four: positively identify your target before you pull the the trigger and be aware of any potential collateral damage in the path of your bullet; you cannot do that in the dark.

Completely agree. That said, my uncle shot a horse when he was deer hunting at age 14 or so. He thought it was a big whitetail. I don't get how even a horse could be mistaken for a deer. He caught so much flak for it, he never hunted again.

I think it had to do more with preserving the resource and making it fair chase, since most "legal shooting hours" were implemented before deer were in close proximity to urban sprawl and more folks than hunters used the outdoors much, and since one needs to positively identify their target during legal hunting hours also.
 
I guess many people here look at their sunrise/sundown charts and stop hunting to the minute. And never took a shot before or after. He should be charged with murder? Then I guess having an accident while driving 5 miles over the speed limit should result in criminal charges. I'm sure nobody here has ever driven over the speed limit.

Obviously, I do not agree with what he did, but I also don't think he should have the book thrown at him. Charge him with the game violation, and it being NY, Criminally Negligent Homicide, the lowest felony class, with a plea deal down to the attempt, and little or no jail time. He attempted at the time to help her with her wound, and is cooperating with the authorities. Most of us will remember a certain politician who drove off a bridge, killing his passenger, and took many hours to report it. And walked away.

I think the local DA is having a problem with this also because as of yet I haven't seen that he's been charged. Being a politician, he's probably checking to see which way the winds of public opinion are blowing.

I read an interview with the husband of the deceased, and while grieving, he realized it was unintentional and seem to harbor no malice towards his errant neighbor. While not a hunter, he's thinking of starting a foundation to teach hunter safety.

Sadly, the woman seemed to be a really good person. Among other things, she donated a bench to the outside of the hospice where she volunteered so patients leaving would have a place to sit while they waited for their ride. Her inscription on it was "In a world where you can be anything, be kind."

Two wrongs don't make a right.

Same with folks who try to "extend" their hunting day. The fact that some have done it in the past without adverse consequences shouldn't give a green light for future transgressions.

Although the story in this link refers to it as a "high powered single shot handgun" I saw another news outlet list it as a Thompson Center single shot handgun which would probably be some form of a Contender or an Encore handgun. Between those two there is a myriad of chamberings available, many of which are rifle rounds. I have an Encore handgun with a 15" barrel in 7mm-08 that's been used at 200 yards but that was only punching paper at the range in broad daylight. I'm guessing that the handgun in question was probably chambered in a rifle round but 40 minutes after legal sundown a hunter has no business firing ANYTHING at that time of day.

He probably saw the silhouette of the woman as the head and neck of a deer, and the silhouette of the two dogs as the body and legs of the deer.

In any case, yeech! This is horrific!
 
He heard her scream and ran up to her then called for help which was 40 minutes AFTER sunset, anything in that absence of light could look like anything you want it to look like.

He's only 34 and will pay the price and has a long way to go in his life to pay that price.
 
Another article indicates that the woman was only about 100 yards from her house and that the shooter didn't have permission to be hunting on the property where he shot.

So:

Hunting after legal hours.
Hunting on property where he did not have permission to hunt.
Shooting at an unidentified target in poor light in an area where he should have expected people to be (100 yards from a dwelling).

That is two willful violations of the law and one remarkably boneheaded decision that violates common sense and the basic rules of gun safety.

I see no reason to defend the guy. What he did goes beyond a simple mistake or a single error in judgement.
 
Know your target and what is beyond. He made a tragic mistake the will alter the lives of two families forever. But sadly stupid people do stupid things with guns everyday. Other than what not to do, this has little value for THR.
