Floridas "Stand your ground" law

Has there been any questionable shootings reported since it came into effect? Anyone know what the opinion among fence sitters is like?

Just wondered. I'm debating this on a swedish forum now, with quite a lot of success actually...I've got a few people on my side :cool:

Can someone tell me what the Stand Your Ground Law is all about,. Sounds like a good thing.
 
I know this doesn't help.

Locally there was a shooting where someone was breaking into a man's house through the window. The owner shot him coming through the window. It was a short blurb on the news. They were saying "...this will be the first test of Florida's new gun law...":rolleyes: . Never heard anything more about it.

I don't know if he made it into the house or rolled back out or what. Maybe he shot him through the window or caught him outside. We never had to retreat inside our own houses.

Simple enough, it removes the 'duty to retreat'. It means that you don't have to attempt to retreat from any place you have a legal right to be before using self defense.

The old standard was one of 'If you can safely retreat, do so', at least outside of the home. The problem that occurs is people who defend themselves with force end up trying to prove that they didn't have the opportunity to retreat safely in court.
 
An extreme case of "absolute duty to retreat" took place in Massachusetts. A strange man forced his way into a house whose occupants were a woman and her baby. She ran from him, carrying the baby, but managed to grab a .22 rifle. She ran to the basement, and the man followed, coming down the stairs. The only other exit was a casement window that was bolted shut and was two feet over her head. She shot and killed the intruder. A judge ruled that she was guilty of murder because she should have retreated through the window.

Even in the collective insanity that is Kennedy's Massachusetts, an appeals court freed her and the legislature changed the law.

I've heard about those fliers. I want to thank the Brady bunch for attempting to teach New York (city not the state) Garbage something about civility. The fliers say something along the likes of, Don't argue with the locals, don't be aggressive, don't raise your voise or start cursing at local people something or another and then says something about the WONDERFUL new law and the price for acting like a typical New Yorker will be a large caliber hole in your torso.


I think it may even be working because the New Yorkers I saw yesterday at the stadium almost could have passed for decent human beings. Well almost that accent is horrible. But they were well behaved they didn't cause any trouble yesterday so +1 to the Brady Bunch fliers.

I laughed when I read teh Brady Bunch's BS about how Florida would be like the wild west, with people shooting each other over some slight misunderstanding. I laughed because Florida was going to a similar law to the one here in GA and we're not the wild west....darn it ;)

An incident happened Sept 28th, 2005, 2 days prior to the effective date of FS776.013.

This was an ongoing dispute between neighbors. The perp and his friends were skateboarding in an empty pool for some time before the incident. Some one had punctured their tires once or twice in the month before. They blamed a neighbor that lived behind and a couple houses down the canal from them but had no proof it was him. One night, 4 of them were drinking heavily. They went to the victims house at 2am, they said to 'talk to him'.

The shooter said the gang of drunk people were yelling, threatening and beating on his door. He said they said they 'were going to kill him'. He opened the door and shot one and the others ran away.

Authorities charged him with manslaughter and then dropped all charges about a month later. "Disparity of Force" 4 against one. If the perp had been by himself the shooter may still be facing charges. This has always been legal. The stand your ground refers to when you are away from your home, (castle), and civil and criminal liability. So the shooter could still be sued in civil because it was prior to the effective date of FS776.013 on Oct. 1, 2005 but has not been as of yet.
 
I don't know, but since the brady bunch has been handing out their crap seems like more tourists than ever clogging the airport and roads. Pretty safe around here long as you behave yourself. Joe
 
There has been nothing on the news in Central Florida about this other than the Brady Bunch pasing out propaganda at the airports.

This case must of taken place many years ago. In Mass we have had no duty to retreat in our own homes for at least two decades. We do have to retreat in public unless one is unable to find a means or able to retreat.

I just flew down to Orlando Florida to visit family and no one was handing out flyers at the airport.

Yeah , after it was covered on the news they quit - they just wanted to be on tv . My wife went thru the airport when they were still doing it and said she saw some woman reading them the riot act. On a later trip they were nowhere to be found. I guess I am glad they are not truly committed and just media hounds.
