giving a C&R rifle as a gift.

as a FFL03 holder I wonder if it is ok on the federal level to gift a rifle purchased using the C&R to a family member. it is not a sale but a transfer i would record on my bound book . here is a for instance.
My dad comes to visit and really likes a M44 I have. can i give it to him even though I purchased it using my FFL? never been able to find this info,.

It's just like selling it from your collection, except you're not making any money. You would log it in your book as a sale even though you took no money for the rifle. The phrase is "engage in business", and you don't want to move enough weapons through your books to appear to be engaged in business.

How many transfers is that? I have no idea. I'm not sure anyone knows and it would strictly be up to the judge presiding over your case after you're indicted.
 
Well, technically you aren't "engaging in business" if you are giving rather than selling the rifle, right?

Record it in your bound book under "disposition" and you're done.
 
If it comes out of your FFL collection, it must be logged out of your bound book.

In other words, log it like any other disposition with name, address, and DL number. As a collector, I sometimes buy two of what I want, keep the best, and sell the other to a friend or family member that shares my likes in historic arms. It's not a legal issue unless you are engaging in a business or acting as a dealer. A few milsurp rifles disposed of a couple of times per year is not acting as a dealer.

If you have not renewed your FFL yet, upon renewal you will be required to indicate the number of acquisitions and dispositions during the previous term. If the numbers are not out of line, it won't be a problem. Every collector buys, sells, and trades.

thanks for the tips. I have been under utilizing my FFL for firearms purchases.
now its getting used a heck of a lot at brownells and midway.
I have had my FFL for a year now. and purchased only 3 firearms. so I don't think its being overused.
