Just before the ban went in effect I purchased a 22 and 23 glock.
Both have two mags and the 22 is still in the box with hang tags because I hooked up the 23 with night sights and internal laser and it is the one I like to CC.
So is my pre ban 22 with both mags more valuable today then when I got it back in '93. I paid around $545 and it is NIB unfired and hardly even looked at.
 
The pistol itself isn't worth anymore. The mags are what went up in value. And of course thats just because of the ban. Otherwise they wouldn't be anymore either. I've seen them going for anywhere around $60-$100 or more.
 
No, you can use the preban mags in post ban production pistols. They just ship from the factory with the 10 rounders.
 
Just mags ,The preban Glocks are just older probably 1st or 2nd generation and new glock 3rd generation with the finger grooves.:)

My mistake, the guy at the gun shop told me the ban stated that any gun made after the ban would be illegal if found with a mag capacity of over ten rds. However, and this is why I went for two, the pre ban gun will always be allowed to have a high capacity mag.
 
You've got it partially right.

After the ban took affect in '94 all pistols that DID take greater than 10rds. in the mag were shipped with 10 round mags. ALL mags made BEFORE that time are allowed to be used in either pistols produced before OR after the ban. No more mags with greater than 10 rd. capacity mags could be made for civilian use. But the mags with greater than 10rd. capacity were, and are, still produced for government and law enforcement use. They are usually marked with "For use by Government or Law Enforcement use only" on them. These are the mags the guy was probably talkin' about.

If I had a brand new Glock 22 produced today that came with 10 round mags I can not use currently produced high capacity mags unless I'm a cop or something. BUT I can use the mags from your gun in mine and its perfectly legal. Its generally referred to as the "grandfather" clause, allowing me to use mags such as yours in my newer pistol.
 
Hardly your mistake. The gun shop guy took advantage of you. It is the mag that is regulated, not the gun or combination of gun and mag (now state laws may be a different matter, but I'm talking federal). As long as you mag was made before the ban you can do just about anything you want with it (exception: you cannot modify pre-bans to work in another gun if said modification prevents it from functioning in the gun for which it was originally designed). Still, you have a couple of nice, dependable guns, enjoy them.
 
fed Vs state law

It is possible I am a little right and a little wrong. Is it possible that in NY, where the gun were purchased, the state law goes beyond fed law in this matter?
 
The only states I'm aware of (someone correct me if I'm wrong) that have their own mag capacity laws in conjuction with the federal law are CA, HI, and NJ. The one in NJ is for 15rds. max and if I'm not mistaken was in effect before the federal law. The other two, CA and HI, have passed their own legislation limiting mag capacity to 10rds. So even if the federal law sunsets next year, like me and alot of others believe will, these 3 states laws will still be in effect.

The same goes in these states as I previously mentioned. Meaning if you lived there before the law went into effect you could keep what hi cap mags you already owned.


NY doesn't have anything like this on the books that I know of. Although I could be wrong.

Thanks for the info. Basically I bought two guns just days before the ban went into effect. After hearing how the gun shop guy interpreted the law, I went for two instead of just the 23 I carry.
Like others have mentioned, the shop took advantage or really did mis interpret the law but I sure don't feel like I got beat because I still have two great Glocks and each has two high cap mags and i did not get soaked on the price. Got my bill of sale out and paid $500 for the 23 and $545 for the 22 and they don't eat much :D

Is what the guy told you recently or back when you bought the pistols? If it was from when you bought them it could have just been confusion on his part too. As the law was still new back then and maybe not fully understood by everyone for alittle bit. I know I was confused when that crap took affect.:scrutiny:



Where at in KY are you if you don't mind saying? Ashland, where I'm at, is over at the tri-state area of KY, WV, and OH.
 
CJ, when I bought the guns is when I got the info. Actually the ban had not yet gone into effect and I do believe there was a great deal of confusion. No harm done
I am in Belfry on the border of WV a few miles south of Williamson.

I've delivered to Belfry before, your way down there. You ever get to Pikeville? I worked for OfficeMax as a delivery driver and thats why I was down your way.

I'm currently on active duty with the KY National Guard at Ft. Campbell. We'll be demobilizing sometime in the summer and then I'll be home for good again. I like delivering for OMax but the money ain't all that great. I got my EMT liscense and am a medic with my unit. When I get back I hope to get on with Kings Daughters Hospital or maybe an ambulance service.
