hi everyone i tried to buy a gun online and went to pick it up at my local ffl dealer they ran the background check and said i was delayed but now i just got denied. before you say i did the vfa and just set it all in. i have never been arrested or any type of felonys the worst i have is a suspended licsense i just have no clue why i would have been denied any suggestions.
 
i was saying i got denied is there just some random denial to make people go through this stupid stuff and hassle or what
 
Doesn't make much sense. You might check to see if there is someone who has outstanding warrants shares your name.
 
for tickets speeding nothing drug related......

i tried i couldnt really find anything
 
When I got denied, here's what I did:

1. Online appeal to find out why I was denied, i.e. "prohibited person". Got an answer within a week on why. You should already know why though...

2. I knew why I was prohibited, so I sent a letter to the NICS appeal team with fingerprint cards and a copy of the court record from my case that was adjudicated. Original charge would have made me a prohibited person, the final outcome was a "county ordinance violation" or basic forfeiture. The NICS system did not have the updated info and it's on the individual to provide it if the the state has not.

3. Wait a few months. I filed mine in September '11 and just got my approval letter this February.

It's a very easy process, honestly. Fingerprints aren't cheap and the wait is long, but the NICS appeal team did what I needed them to do.

With a suspended license, it could be a factor. If you have unpaid fines in some places, they will put out a bench warrant and you become a "fugitive from justice"

I think it depends on the reason for the denial. If they thought you were someone else with the same name, no biggie, if you have charges it could be a whole rat's nest.
 
What state do you live in ? Is your state a POC (point of contact) rather than a straight Federal NICS? Do you have any unpaid tickets or outstanding fines that the state would deny the background check?
 
Also, the VFA doesn't help if they are using YOUR record to prohibit you. If your record is clean, then the VFA should help. If your record is not clean, you need to find out what is on it.
 
no unpaid fines when my licsense got suspended went to court and paid all my fines thats all taken care of i live in ohio and dont know about poc
 
I got denied buyimng a rifle at wal-mart once. I stood there and made the guy run the check over and over until he finally figured out he was doing it wrong and I got my rifle.

Probably different then what you're going through, but every system has it's glitches.

I would think that if your FFL can't tell you, then there should be a help line with the NICS(or whatever) and they can tell you why it was denied.
 
OK, here's the procedure:

1. Get the NICS transaction number (NTN) from the FFL, and any OH state number if they are involved.

2. Either email or fax NICS (be sure to specify the NTN), asking why you were denied. You should have an answer within a week. The FFL should have both the fax and email address to use. Do NOT waste time calling, they will tell you ZERO over the phone.

3. The reason you get will only state one or more of the federally prohibited criteria such as "you have been convicted of a felony" etc.

4. If you think they are wrong, follow their instructions, get fingerprinted and mail the information to NICS appeal section. If you think the problem is likely to occur again (mistaken identity say), consider submitting your appeal along with a Voluntary Appeal File, this way they know the story not just this time, but every time.

5. Wait 6 months or so for your certificate, go pick up your gun.

Sorry to say but it's no, and no.

The FFL does not know and NICS will not discuss it over the phone. I outlined the procedure in a previous post, it needs to be followed because that's how the system works. Not saying it's great or anything, it just is what it is.
 
I don't know where you live, but if you can:
Get any loose ends taken care of. (In accordance with the chl laws of your state)
and get yourself a carry permit. In the great state of Texas, you won't get turned down again.
 
If NICS denied him he won't get a carry permit in TX. Part of the reason permit holders in certain states are NICS-exempt and others aren't is whether or not the state runs the applicant through NICS when processing a permit application or renewal.

His only recourse is to go through the appeal process. It will take months but he will get an answer either way, and can move on from there.
 
I used to get denied all of the time thanks to someone stealing my identity. I would get the NTN from the dealer and head straight to my local sheriff office and get finger prints. I would mail everything into the FBI and usually I would get my letter/certificate back within 3-4 weeks of the initial denial. I did the VAF back in 2006 and had to update it once because the person that stole my ID got in trouble again, but that only took about 3-4 weeks also. It is faster to just send in finger prints right away with a letter (include NTN) asking why you were denied.
