Got Denied

I got denied once. Turned out it was because a state forgot to update my info after paying a traffic violation. Long story short, got a ticket in neighboring state. Payment sent in mail. Six months later denied purchase of rifle. Find out state never cleared me off their 'list'. State cleared my name, week later purchased same rifle from same shop.

I got denied late last year buying a shotgun for my son for Christmas. This was about 6 months after I got my C&R, and about 2 months after my last gun purchase. I had a LEO neighbor run my name and it came back with a warrant for an unpaid traffic ticket from about 3 years ago for an expired registration. :cuss:

My wife gets really irritated with me because I save more receipts than she thinks are necessary. It took me about 5 minutes to find the receipt showing that I had paid it. When I ran it over to the court, they had the ticket marked as 'paid', but not as 'fulfilled'. :cuss: x 2. They cleared the warrant, give me the paperwork, and I drove to the BCI office about an hour away with the NTN and the court paperwork and had it cleared after waiting about 10 minutes. Drove back to the pawn shop and picked up the gun the same day.

Something to look at with the Suspended License is to whether they consider that valid ID, kind of like an expired license not being valid.

will a sr-22 bond deny me the right to buy a firearm
SR-22 is just proof to the DMV that you have the minimum amount of liabailty coverage. It may be required for many reasons including getting caught driving without insurance, DUI and others. I can't imagine how that could make you a prohibited person but not much surprises me these days.

If you asked NICS why you were denied when you first posted here, I imagine you should know this week. I think they are required to provide an answer in 3 business days IIRC.

i hope so some people were saying it took five months i just dont want to wait that long to hear something from them i sent all of my appeal papers on thursday. just asking do they go back and look at your juvenile records there isnt anything but some people said that was there cause of not getting approved

NICS Appeals

Individuals who are denied the purchase of a firearm may request that the NICS or the state which processed their transaction provide the reasons for the denial. The regulations address the process for filing an appeal. Appellants must include the NICS Transaction Number (NTN) or State Transaction Number (STN) assigned to their transaction. To ensure all necessary information is received for the appeal request, the NICS Section encourages appellants to apply for the reason for their denial via the NICS Appeal website. Appellants without Internet access may submit their appeal via the NICS Appeal facsimile at (304) 625-0535, or by mail to the FBI, Criminal Justice Information Services Division, NICS Section, Appeal Services Team, Module A-1, Post Office Box 4278, Clarksburg, WV 26302-4278.

Did you request the reason first or just send them "appeal papers"? I always recommend following the procedure as outlined on the FBI website, I won't beat that dead horse any longer.

As far as whether they consider juvenile records, they are looking to see if the transferee meets any of the federally prohibited criteria below. If a juvy record gets someone there, then I imagine they would consider it, if it's not sealed.

The federally prohibiting criteria are as follows:

A person who has been convicted in any court of a crime punishable by imprisonment for a term exceeding one year or any state offense classified by the state as a misdemeanor and is punishable by a term of imprisonment of more than two years.
Persons who are fugitives of justice—for example, the subject of an active felony or misdemeanor warrant.
An unlawful user and/or an addict of any controlled substance; for example, a person convicted for the use or possession of a controlled substance within the past year; or a person with multiple arrests for the use or possession of a controlled substance within the past five years with the most recent arrest occurring within the past year; or a person found through a drug test to use a controlled substance unlawfully, provided the test was administered within the past year.
A person adjudicated mental defective or involuntarily committed to a mental institution or incompetent to handle own affairs, including dispositions to criminal charges of found not guilty by reason of insanity or found incompetent to stand trial.
A person who, being an alien, is illegally or unlawfully in the United States.
A person who, being an alien except as provided in subsection (y) (2), has been admitted to the United States under a non-immigrant visa.
A person dishonorably discharged from the United States Armed Forces.
A person who has renounced his/her United States citizenship.
The subject of a protective order issued after a hearing in which the respondent had notice that restrains them from harassing, stalking, or threatening an intimate partner or child of such partner. This does not include ex parte orders.
A person convicted in any court of a misdemeanor crime which includes the use or attempted use of physical force or threatened use of a deadly weapon and the defendant was the spouse, former spouse, parent, guardian of the victim, by a person with whom the victim shares a child in common, by a person who is cohabiting with or has cohabited in the past with the victim as a spouse, parent, guardian or similar situation to a spouse, parent or guardian of the victim.
A person who is under indictment or information for a crime punishable by imprisonment for a term exceeding one year.

Hopefully it was because of his lack of capitalization, punctuation, and grammar. I mean really.

says the man who spells his name and state in common noun form:

Just sayin'.

Gee Know

I was recently delayed for thirty days for no reason at all.

Government "in action". (promote the laziest liberal living to run the NICS)

Guilty until proven innocent! We could start a new country with this principle.

I hope Webster aint readin this. LMAO

Instead of spell checking he should read the Rules.

Blame that on your state or gun shop policy ... not on NICS.

Max delay from NICS is 3 business days ... if no further response the dealer is permitted to complete the transfer ... unless state law (or store policy) says otherwise.

geez man, the list keeps getting longer. Sounds like you have a lot of things in your past to straighten out. (im no counselor by all means) But it sounds like you need to straighten your personal life out before you go blowing money on more firearms.

Im not sure about the debt in itself involving a denial. But I think it would probably fall under the "fugitive" from justice If you have been filed against in court for the debt and are dodging the a court appearance or something of that.

Everyone has issues some time or again in life so Good luck. But get it all straighten out man, it will only come back to bite you later.

but how long does it take to get a letter stating why you were denied from nics
Going back though my records, I was denied on a Monday the 7th, faxed and emailed NICS on Tuesday the 8th asking for the reason, received the reason in a letter dated Wednesday the 9th on Friday the 11th. So, letter received within 3 days of request.

You never know when you will be added to the banned list and for what reason.

The NICS system was set up for one reason. So that anti-gun groups could petition the government to add more and more people into the list of people banned from the right to keep and bear arms.

no still waiting i getting aggrivated cause i am waiting on this gun the one time i try to do things by the book it comes back to bite me in the ass. im trying to get this gun to take my ccw but now its just a waiting game i guess i hope to hear something soon i sent the appeal and wanting to know the reason for denial on the 15th

Paranoia.....its whats for breakfast.

Nope.
While you can usually attribute every federal requirement as the fault of the antigunners, the FBI NICS IMPROVED the previous system which mandated a waiting period while your local PD ran a background check.

The FBI cannot just arbitrarily add categories to your "banned list", the prohibiting factors have been part of Federal law since 1968.
