NEW ORLEANS — A National Guardsman shot and killed a man who threw a piece of broken glass at a group on patrol and later pointed a BB gun that officers mistook for a rifle, police said.

Homicide detectives are investigating the shooting, but the guardsman, whose name was not released, appears to have acted appropriately, said Sgt. Joe Narcisse, a police spokesman.

The dead man did not carry identification, Narcisse said. Family members identified him as 53-year-old Terry Burton.

The National Guard members saw the man at about 1 a.m. holding a hacksaw while riding a bicycle through an area that remains largely vacant since Hurricane Katrina.

The Guard has been patrolling less populated areas of the city since June to allow the depleted police force to concentrate on areas where people have returned since the hurricane.

The guard wanted to check him out because thefts of copper pipe are common, National Guard spokesman Col. Pete Schneider said.

"As the guardsmen approached the man, he produced a knife, threatening the military men and then threw a piece of broken glass at them, cutting a sergeant's arm," Narcisse said in a news release.

The man ran into a rundown house, he said. When police and guardsmen entered the house and approached the man, he pointed a BB gun that looked like a rifle at them, officials said. A Guardsman shot the man several times, police said.

The guardsman who shot the man is a 10-year military police veteran, Schneider said. He was removed from patrol duties, Schneider said.

This was the second shooting by the guard since it returned to the city in June. The first was not fatal, Schneider said.

The shoot was good no question but I'm not happy that after all this time we're still using the NG as cops to protect copper pipe.

Come on Nagin, do something besides stand in front of the TV cameras will ya?

Copying a story is (c) violation. Whether or not money is charged is irrelevant.

Most outlets will allow a "reasonable" amount for teaser, and you can have excerpts for "Educational" purposes.

The dead guy probably heard about it and assumed the Guard MPs were going to run away.

Perhaps the Guard should post the mission ROE online as a public service. :D
 
Martial law is a legit use of the Guard.

Would you rather they weren't protecting American people and property against punks like this?

Guarding the border against unarmed civilians is NOT a Guard mission.

It would be even worse with 2 week rotations.

And if you think "The Guard" are just some bunch of guys with nothing else to do but sit on the border at your whim, we need to talk.

But thats his job. Not doing anything useful or productive. And his employers must be happy with his work, since they rehired him AFTER Katrina rolled by.

Sounds like a good shoot to me based on the data provided. Natural selection at work (provided he'd not already reproduced).

Wow, it's pretty scary that nobody here sees MAJOR issues with imposing martial law on NOLA like that.

The military SHOULD NOT be used as a police force against civilians unless MAYBE under conditions of open insurrection.
 
You can get shot for pointing a plastic toy gun at someone, and justifiably so. So why would this nut not think he was going to get shot for pointing a BB gun? He was the only one who knew it was a BB gun.:rolleyes:

Wow, just think of all the neat propaganda about privately owned guns if there were no cops or military in the bad parts of NOLA.

People would be shooting criminals.

Taking law into their own hands.

Vigilante justice.

Now, I don't have a problem with that at all...but you can bet how it would play on the news.

And since this was a legitimate shooting, what's the problem? "Martial law over civilians." BY DEFINITION martial law is over civilians, and in this case, punks who'll attack armed, armored soldiers.

What would they do to unarmed civilians if there weren't any troops there?

Especially after Nagin seized the guns...
 
I'm law abiding and all, but I was *shocked* at how the "rules of engagement" can change after a natural disaster where the ARNG is out there keeping order and preventing looting. I know a guy who was in my state's Army NG about 16 years ago who shot at a looter along with his squadmate - the looter wasn't pointing a weapon at them, he had simply driven an airboat up to a house and was emptying the TVs etc into his airboat. His airboat got a couple of .223 holes put in it while he was di-di ing away, but just damn! If I have to evacuate due to a hurricane or something, I'm not likely to try to sneak back in before the let us, now.

That's what I said. They can only shoot against threats. The same RIGHT anyone has.

Martial law would enable them, with SPECIFIC authorization, to shoot looters to maintain property.

The Guard may certainly be mobilized SUBORDINATE TO CIVIL AUTHORITY to protect property and public safety. There are specific laws and regulations to that effect, and have been since the Guard was made a federal bureau in 1903.

And even if he's hungry, that copper belongs to the person who owns the house. He can get a job. It's not as if there isn't plenty of work to be done and a shortage of people at present.

Shoot at an armed man, get what's coming to you.
