Louisiana National Guardsman Wounds Suspect While Patrolling New Orleans

NEW ORLEANS — Two Louisiana National Guard soldiers shot at a man suspected of wielding a weapon Monday, the first time any guard member patrolling the city has opened fire, officials said.

The shooting occurred when the man, whom police didn't identify, refused an order to drop an object in his hand as he approached the soldiers.

The man was wounded in the upper torso near his back, and his injury was not considered life threatening, police said.

In June, 300 National Guard members were sent to the city to patrol areas largely abandoned since Hurricane Katrina, said Lt. Col. Pete Schneider, a Louisiana National Guard spokesman.

Sgt.Robert Lawrence, 21, an Iraq war veteran, and his patrol partner, Pfc. James Neely, were called over by people who pointed out a vehicle, saying its driver "was involved either in a dispute or a hit-and-run," he said.

The man's driving was erratic, so the soldiers pulled him over and ordered him out, Schneider said.

"When the suspect got out of the vehicle, he had something in his hand that our soldiers perceived to be a weapon," Schneider said. "So our soldiers took defensive positions, and ordered him to stop and drop what he had. He continued on."

Schneider said the soldiers fired twice; a shot fired by Lawrence hit the man.

Schneider said the object the man carried was possibly a cell phone.

Nobody was arrested Monday but the investigation was incomplete, police said.

The shooting occurred on a block where most houses had been or were being repaired, although some still had boarded or shuttered windows.

I have a good friend who came within a second of being shot by police. He was stopped for speeding got out of his vehicle and walked back toward the police with a cell phone in his hand swinging his arms in a natural walking fashion. I talked to the cop and he told me he was within a sec of pulling the trigger while screaming for my friend to drop it. People are just shocked cause they are in no way even thinking about a cop thinking they could be a bad guy. The cop told me he was shaking afterwards as he knew he almost shot an innocent man. A well known average guy in the community. Business owner, father, husband, hunter just someone who had no idea the situtation he was in. Scary. Yes. Understandable yea. Would have been life changing event. Espically in a small town where everyone knows almost everyone else. Most people are not given a manual on how to act when stopped. Most have never thought about it. Alot espically in small places think they are being polite to get out of the vehicle. I know I would not have thought anything about it before reading here about horror stories.

I saw it on my local news last night; as I live right outside of N.O. The NG was called back into the city because of the resurgence of crime (laborday weekend= over 10 shootings). On local news, it was said the guy in the car had assaulted another person just before, and was behaving like he was intoxicated. It was also said he was hit somewhere in the left torso, but that his wounds did not appear to be life threatening. Note to criminals: not advisable to stand off with soldiers just returning from Iraq.

On the "lookout he's got a cellphone" point, I have an ALS simulator at my store. It projects a scene on the wall with actual actors. Situations unfold, people move, talk, pull weapons, make furitive movements, etc. I use it when I teach CCW.

There is one scenario with an attempted robbery. Within seconds of the initial issue, there is an innocent bystander that blunders into the situation. The bystander has a cellphone in his hand.

You would be surprised how often the only reason the dude with the cellphone lives is because the student MISSED. :)

So I wouldn't talk any smack about these National Guard guys.
 
Anyone surprised like me that the NG is still in NO?

I live here, and I'm not suprised at all. The simple fact is that there aren't enough policemen to go around, and there isn't any money to hire any right now. They'd also have to be trained, so there is a time gap in that too. I drove down to 9th Ward today, and saw a number of guardsmen on patrols. I'm glad they're out there.

At the LawDog Files blog, he listed some per-capita numbers of police for similar-sized municipalities. This was at the time the newly-re-elected Mayor Nagin requested a return of the NG.

New Orleans, per the Dog, had more cops per capita than other cities of similar size. By as much as double...

Lets face it, we have lost N.O. Its time to pull our troops out and turn it over the UN. Lets get out and declare victory. Yep, nothing to fight for there, our boys are in harms way, lots of lies got us there, just a war for the oil in the gulf of mexico, etc..

We need a date certain for a full pull out.
