Handgun Permits in NJ how long can they make you wait?

How long can the police make you wait to get your permit to purchase? I thought it was like 30 days and if they can't find a reason to deny they had to give it to you. I've just gone through the background check and picked up a permit in august and put in for another the first week of september and 2 days before november I'm still waiting:banghead: and the detective hasn't returned any of my 12-15 calls I placed over a 2 week peroid

While the law says 30 days, the courts have held that "it is in the interest of society that the police be given as much time as they need to perform the background checks", or something like that.

Lawyers will tell you that there simply is no adequate recourse available, short of ultimately taking them to court, if the delay is extreme (Ie, > 3 months)

Some tips:

1) Do not alienate them, you're vulnerable at this point. Be polite and courteous.

2) Keep a detailed log of calls, copies of letters...(you did write letters of inquiry, didn't you?)

3) A call a day is probably not going to help you. They'll mentally file you as a PITA, and put you on the bottom of the pile.

Also remember that they are the same people who give you pistol permits . . . . . imagine waiting a few months anytime you want to buy a handgun? It is the same form you know. I get my pistol permits in 5 days. I got my FID in four weeks or so.

Thank God I live in a nice conservative Republican county.

Be polite be courteous and document everything. If you harass them or loose your cool they will turn it right back on you.

I'm not sure if the 30 days is correct but if I were you, I would give them double the time, start calling whoever is in charge. Do that for some period (2 weeks, say several phone calls) then start with certified letters asking for a response on status documenting your messages and phone calls.

Document everything so if it needs to go to court it can. Keep it professional. WHat they are doing is illegal and a violation of your rights.

My freind lives in North Caldwell, they lost his application twice - "no record of it" with lines right out of the Evan Nappen book like why does a nice family guy like you want a gun anyway?

(The answer there is because when Newark explodes in riots again, I need to be able to shoot the people trying to rape my wife and steal my children because you'll be hiding in the Police station wetting yourself.)

Consider moving to a more gun freindly town if you need to stay in PRNJ.

The only thing you can do is cooperate. I have a lot of Jersey friends who shoot, and as far as I can tell in very few cases are the police purposely "suppressing" your application. Most of the time it really does take them a long time to get through, and it's the law's fault, not their personal fault. If they're giving you flak about "why would you need a gun?" then it's a different story. Thankfully I have not run into this during my time here, and the police I have interacted with have conducted themselves professionally.

One guy's permit, that I know of, took seven months because of the backlog of permit applications post-9/11, when everyone wanted to get a handgun. Mine took two months, and I know for a fact they did it as fast as they could (it was my SBI check that took awhile). If your references haven't responded to the police queries, that could also be an issue.

Subsequent handgun permits should take less time because there is less involved with getting those. Likewise with an address change, my local department was extremely professional and helpful in that regard.

In short, you have no choice but to be professional yourself, and hope that this generates a professional response.

Geek with a .45 yes I do shoot at Hagues I'm a member. And Raven you're right it should take less time because all of my background checks were just recently done and thats what the detective said to me I guess the thing that gets me the most is is that the detsctive said I should have my permits in a week 2 tops and i gave like 5 weeks if it takes longer fine but don't lie to me and it burns my ass that
I can't get a 1 minute courtesy call back to tell me that its either ready or I have to wait alittle while longer I wouldn't mind if they acknowledged my existance. And as far as the 2nd ammendment goes as far as I'm concerned the permits are illegal since it says I HAVE THE RIGHT TO BEAR ARMS not the privilege and since I am a law abiding tax paying citizen why should I be punished? In all seriousness I can make a phone call and within 2 hours I can have any gun I want but when you try to do things the right way they bust your balls and they wonder why theres so many gun problems. And with the background checks thats a total crock with how long it takes. PA can do a 10 minute check why can't NJ? Do we not have the same technology are we 20 years behind ? Besides when you get pulled over the officer has your background on his laptop before he gets out and asks for your license and registration so why can he get it in 2 minutes on the road but at the actual police department takes 2 months?

The only conclusion that I cannot escape is that NJ has decided that it does not like gunowners, and will use every administrative and regulatory tool at it's disposal to discourage the keeping and bearing of arms, and has been doing so since 1966.

It has worked.

Gunownership is like 12% statewide.

Well it is bad,but once you get the safe cert you can buy one pistol a month
with only the waiting period to worry about.
My brother is a cop in NY and he was told he may not carry HP ammo in PRNJ
only there they're refered to as "dum dums".
So the politicritters want FMJ over-penetrating ammo only ,no need to worry about bystanders in PRNJ ,right?

New Jersey legislators do not want to empower their citizens with rights. They run the state with it's people as subjects. This makes it easier for the labor leaders that have paid for campaigns to rape and pillage municipalities.
It's a lot worse than you might think. We left 2 1/2 months ago and it's very sad, in a way, to now live in a town that's run very well knowing that I left behind the victims of "the axis of evil". They do nothing so ****'em, I guess.

Dbl0Kevin, I thought I had the record at 6 months?!! The shortest turnaround I have heard of was 3 weeks.

14 months...10 months?....OMG, I fought the good fight for 10 years in NJ....sorry, but I took a job in PA 3 years ago and left that mess behind and haven't looked back.

I can carry now (no way in NJ)....and purchase anything I want in the same day.

Do a John Galt...shrug and move on to greener pastures.

Depends on the Township. I get mine in 2 weeks or less, but my SIL, who lives one town over, took 14 months to get her's. They kept claiming that the NJSP messed up the background check over and over again.

BTW, where is Hagues? Is that the former "Eagle Eye" in Deptford (where I normally shoot), or somewhere else?

I was a member for years, but Sue started to really get under my skin and I let my membership lapse. They would bitch and moan every time I asked them to do a transfer (which was suppose to be a member benefit). Then they refused to do transfers from CDNN. The last straw was all the local LEOs shooting there. I got tired of being constantly muzzle swept with loaded guns by clueless folk in uniform who had their fingers in the trigger guard. There where many times I saw things that made my crap my pants, pack up and leave for my own safety. I started doing my transfers at Bob's, and then my shooting there.

I've been back a few times this year, and really like the new owners, just didn't know what they where calling the place. If I stay in Jersey for another year, I may rejoin.

When I first moved back to Jersey from the military it took me 6 months in Burlington.

Being in Correction in Jersey, it is considered LEO, with the right to carry. And I still had to wait 6 months for my Off-duty.

Pretty much now, I get them in about 3 weeks. 9 more years until retirement, hello flyover country.

Gusgus I like the new owners too and Dave is a pretty cool guy and seems to know his stuff but don't get transfers there they charge $50 + the $16 check abit much for me

Just another piece of advice:

When applying for pistol permits, you are allowed to apply for as many as you like. I now get 6 at a time. They only cost $2 each and are good for 90 days. At the end of the 90 days, you can renew for another 90 for no extra charge.

It really varies a lot by municipality. I live in a conservative suburban town where I get my pistola permits in 2 weeks or less.
