Only 2 out of 13 states mention self defense as a condition of bearing arms in therir constitutions.

Is self defense an individual right?

That's not what happened here. 2 sentences later he took the alternate path when talking about Miller.

Listen to what the Justices are saying in regards to handguns. Breyer himself took after handguns because they were not "of a type in use" by the military.

His own words can be used against him regarding MGs if we ever get a case to that point.

Machine guns are not relevant here, as much as we'd like them to be.

Well great. Doesn't that mean they aren't protected? Didn't seem like a good factoid to throw out there. I wish I could listen in or get a transcript.

In Mass we have safe storage laws. Not good!

Cant say I like where Gura is going on Licensing and triggerlocks. Likewise, I dont like how he framed his comparison of pistols to machineguns. He started off strong, but it seems like he's backpeddling to the 'moderate' side.
 
Gura (Hellers attorney) is not helping. But it sounds like the majority of judges are on the side of the 2nd as we (on this board) know it.
 
Gura is very good.

I disagree, he is not very dynamic. He could have owned the court on the MG if he had used the SG's argument rather than falling back on his weak points from his brief. He didn't do a good job of pushing the argument in the direction he wanted to go and isn't thinking well on his feet.
 
What exactly did you think was going to happen?

It's more important to listen to the questioning of the Justices here.

They are not tearing into Gura anywhere close to how they did Dellinger.

Remember also that the Justices questions are not at all a good predictor of what they are really thinking.

Dellinger is back up now. Gura didn't do that bad really. Dellinger is going to go off on trigger locks and stupidity so be happy :)

10 seconds into his closing and they are on his ass again :)
 
well, now that we're away from machine guns and licensing, and back to handguns, the arguments are going much better. Thank god. That was getting a little scary there for a minute.
