Wow, calling it the "Make my day" home invasion case. Said homeowner shot them with an assault rifle. Tragic all around.

For once though the perp says that the homeowner had the right to shoot them and protect his home.

She recalled: "I heard the gunshots and I waited and I waited, waiting for them and then Jake came out. I seen him by the gate and he slid across my car. All I could hear him say was, 'I got hit.' He fell down in the driveway."

Rodriguez sped off but surrendered to police just hours later. She revealed that there was somebody else in the car with her who is believed to be a 15-year-old girl.

Wow. And at 15-18 years old. Just imagine what these guys would have been up to by the time they were 25, probably after some "education" in prison. What a waste.

That young man absolutely saved an innocent life, maybe several. I hope he realizes that.

This is the problem with "trophies for everyone", "everyone passes" classes, no accountability for your actions, and first offenders get slaps on the wrist because they're young, that's being taught today to the younger generations. Not everyone teaches this. There are still good parents out there. Many in fact. But this is exactly what happens when those entitlement ideologies manifest themselves.

Did anyone mention that he took the 3 perpsdown with 3 shots? No 44 mag, but "Make my day" indeed. When he's old enough, I'd buy him a beer and give him a Marksmanship trophy.

Wagoner Co DA, decides not to file charges against the shooter......Winning.

This may sound crass to some, but I'm wondering if he'll ever see his AR again. I was looking at my AR this morning thinking I hope I never have to defend myself with this thing because on top of all the other bad stuff that would happen it would go into an evidence locker and God only knows if would ever see the light of day again.
 
I've got some friends in the Wagoner Co Sheriffs Office. I can find that out. But without filing charges, evidence for/to what crime?

So what??? He is alive and can buy a new one. Worrying about whether or not you will get it back from the police should never even come to mind. I know folks that carry Hi Points and Ravens because of fear they would lose a good gun to the cops. It is very poor rationalization.

Yes, he should be able to get his rifle back. He may have to go to court to get it, or it may be summarily returned. It just depends on the department and DA.

The shooter committed 3 homicides which are crimes. He may not be prosecuted for them, but they are crimes none-the-less. Law enforcement will hold onto the weapon until at least all the ballistics are finished with the case.
 
Just because the gun wasn't used in a crime doesn't mean you'll ever see it again. It depends on the department. Some will make the effort to return the gun, others will hold onto it like it's finders keepers. I've read about cases where guns were ordered to be returned by court order only to find out they had already been sold in a police auction. If the police take your gun for any reason whatsoever, don't count on ever seeing it again. And count on it being a hassle, and potentially a fight, and costing more in legal fees to get back than it's worth.
 
I dunno if I would want the gun back, personally.

A .45-70 that dropped a charging bear that I stumbled upon while hiking, sure that gun would go over my hearth.

A rifle used to kill 3 human beings (rightful as it certainly was), I don't think I'd want to look at it again, honestly.

I'd just be happy to be alive and not in jail and fine with buying a new gun.
