How is a flare gun not a firearm?

You're sure don't, but we all have opinions. Just had to ask why this was an issue. If you want to determine the legality, stick it in your waist band and walk into a police station. If all you want is to ask a mute point, you don't need anyone's permission to do it. Sorry you seem to struggle with my opinion, but thats why America is Great.

And for the record, I believe my comment was useful. Others on here have basically said the same thing. Its not safe, its not a good idea, or there are a lot of other better ways to cap off a 410 shell.

As a more direct answer to your question, it all depends on the state you live in. On another thread in this section, the subject of "gun modifications" and the negative it might add if you are involved in a shooting [see trigger job]. The general consenses is it sure doesn't help and a few could work against you when a non gun member of the jury heres the details. The same is true with your good old flare GUN. If you want to risk getting jacked up by LE, who am I to question you?
