I currently live in the state of Illinois and would like to move my guns out of state. I only plan on staying in Illinois for a few more years and do not wish to sell any of my guns. So, how can I (if possible), legally OWN the guns, but store them out of state? It is my understanding that even if confiscation/ban schemes were to be enacted, I could still legally OWN them, just not possess them inside the state. I would be willing to store them at a public storage facility in a neighboring state, and pick them up when I can move to a more gun-friendly state (I assume there are no laws against this?). Would this satisfy the law if the current bills are passed? Sigh.

It's an Illinois law. The guns don't exist in the eyes of Illinois law if they're not within our borders.

Lets fight first....

I know what you are feeling. And if we lose the fight, I will move out of Illinois, even if it means bankruptcy because I can't sell my property down here in Marion County (11% unemployment last month).

But let's fight first.

Are you sure ? I do NOT know. The way it was explained to me was that not only did I have to get mine out of the state but that I would have to have paperwork showing the transfer to an out of state FFL for handguns and buyer or FFL for long guns.

Don't forget in ILL the State Police have a record of every gun you have ever bought from a FFL.

Again I do NOT know, I am calling and writing to fight this but I would like to know for sure. ( I have a friend with a house in Ind but I want to check the legalities first 0

Nukemjim,

The ISP does NOT have a record of every gun you've purchased from a dealer. They would have to do the same thing the BATF does and go to the dealer and collect the 4473s. Without a state law (state license), they have no legal authority to do that as the FFL currently operates under federal law. The BATF is currently fighting the state over turning over 4473s for a lawsuit.

Until Daley gets national political office his reach ends at the state line. The burden of proof that you possessed illegal semi-automatic assault wepaons would be on the state. Not on you. Move them across the line to your friend's place in Indiana and they can't touch them. Nor you. The law only applies in Illinois. Casino (non riverboat) gambling is illegal in Illinois, yet the ISP doesn't arrest Illinois residents in Las Vegas casinos.

The law doesn't say anything about ownership because it can't. It says you can't possess them in Illinois. You can be in Illinois, they can't. Simple. It makes no difference whether the ISP knows or doesn't know that you own an AR15. The law does not set a penalty for "not turning in or destroying" the guns, because it cannot do so. The penalty is for possessing them after a certain date. How the guns get out of your possession is not their business as long as you don't sell them or transport them inside the state after the law takes effect. If you get them out of the state before the law takes effect, you're fine. After that, you can't transport, mail, or sell them without breaking the law. 90 days after it takes effect, you can't even have them in your possession without breaking the law.

Yes, I'm sure. If you don't believe me, call a lawyer. But then, if you don't want the advice, you don't have to ask for it. ;)

Thanks...

for the input everyone. I'm not leaving yet, and I will help the cause until I do. I'll even try to help after I do leave. I asked my question because I am paranoid and want to make sure I am completely legal before I start "causing waves." It really is ashame what Illinois has become in regards to gun laws.
