A 19 year old person cannot buy a handgun because the law says that an FFL can't sell you one if you're under 21.

Now, a 19 year old can buy a handgun from a private individual because the law says you have to be 18+ in order to do that.

Here's the hard part, can this 19 year old person buy a handgun from an FFL who's selling it from their own personal collection and not the gun shops inventory?
 
Private sales

Private means private. End of story, however I was at one of our class three dealers last summer and was informed that any transactions need to take place outside of the gunshop or a 4473 has to filled out and the call made due to fact a gun and money are changing hands in an ATF regulated buisness. So purchase away, just so long as it isn't in the gunshop.
 
In Virginia, and many states .... your parents can buy a gun for you as long as its a GIFT. That is key, you can not give mom/dad money to buy you a gun .... it MUST be a gift (or else its a staw-man purchased).


Not sure about FL law, but it sounds like its a simmular to VA.
 
I have heard of BATFE agents telling dealers there is no such thing as a "private sale" for an FFL holder. I don't know if that is true*, but I know many dealers like A la Dan who will run any private sale through the store. One advantage of that, from the dealer's viewpoint, is that the check will show if the buyer is clean. The last thing an FFL dealer needs is being caught in a "private" straw purchase that has him selling "off the books" to a convicted felon or an underage buyer. He would probably lose his license.

*It could depend on whether the licensee is an individual, the store owner, or whether it is a corporation that owns the store. I simply don't know.
