Just another reason you should always relish your chance to sit on a jury. You may be the one who helps keep an honest man out of jail or help to put a slick lying sack of crap behind bars.

Well, the problem is, that if he loses (I'd say highly likely), the constitution will have been narrowed, again:cuss: :banghead:

"I'm going to ask questions, what else can I say?" he said. "There is a 2nd Amendment, and it means something, I hope."

Not anymore :(

The objection to constitutional arguments came from Assistant U.S. Attorney Wendy Johnson, who filed a motion several days ago asking U.S. District Judge Jimm Larry Hendren to prevent Fincher and Stilley from raising any such issues.

Why would she do this unless she thought it could damage her case??

Between this:

and the media citing blogs as source material, we know the republic is now
doomed....:p

Authorities said the arrest culminated an eight-month investigation that included having a undercover agent attend meetings of the militia. The investigation was collectively conducted by the ATF, FBI, Washington County Sheriff's Department, Fayetteville Police Department, Springdale Police Department, Arkansas State Police, Arkansas State Bomb Squad and the Madison County Sheriff's Department.
Enemies of the Constitution, all of them. I only wish this man had used one of his machine guns as they attempted to arrest him. That's what the Second Amendment is FOR.

While I believe full-auto fire from shoulder arms is generally pointless except at very close ranges (like room-clearing), I hope something good comes of this court case. If arguments based on the Constitution are not allowed to be presented (on what pretext, I wonder?!), then the trial will of course be a joke.

Since 9/11 there's been a lot of talk about terrorists who "hate us for our freedom," blah blah blah. Without getting into the true reasons for terrorism, I will admit that terrorism is a (hugely overstated) threat to our safety. It is NOT a threat to our freedom. The SOLE plausible threat to American freedom is the US government. It alone makes the laws, and it alone enforces them. This is a plain fact. And we've seen, over and over, just how much the US government "respects" the Constitution. It pays it lip service, then takes a giant crap on it.

Regardless of the trial outcome, the scope of the Second Amendment is not up to the courts. It's up to us. We have the weapons and can use them to fight for our rights whenever we want to. But how many people will be willing to do so?
