Indiana carry

I'm going to be in Indianapolis for a week or so in August, and have looked up the laws concerning concealed carry there. I have an AR CHL with reciprocity in the great state of Indiana. My current understanding is that there is no legal signage that prohibits the carrying of my CCW in a building that I would otherwise be legal to carry in (IE- not a school, etc.). Is my understanding correct? Here in Arkansas, if a building is posted no handguns, we may not legally carry within that building even if it would otherwise be legal to do so. Thanks for helping to clear this up for me!

Concealed means concealed. Having said that, if an establishment posts "no guns" I take my pistol off or don't buy anything there and move on. If you got caught they could tell you to leave and if you didn't I guess you could get charged with trespassing.

There is no standard sign to identify a NO GUN building. But if there is a sign on privately owned store front (I've never seen one) just walk on by. Check out the Indiana State Police web sight, it has our ccw laws. http://www.in.gov/legislative/ic/code/title35/ar47/

While it is a good idea to keep it concealed it is not necessary. I have on a couple occasions open carried and never had an issue. In Indiana it is a "License To Carry Handgun" not a "Concealed Carry Permit".

As far as places that are off limits it is really only federal buildings ie courthouses, riverboat casinos, and airports. If a private business has a sign posted they could kick you out, but other than that there really is no legal recourse.

As always look up the laws in the state you are visiting to make sure what people are telling you is correct.

ICC 35-47 is the code section. There are some local laws still in effect that where passed into law before the pre-emption date. The one in Indy is the prohibition in parks. City parks are off limits to lawful carry. State parks are legal. Within the city the State Fair is off limits. City County building, federal offices, and k-12 schools are off limits.
Some state agencies may have offices posted and admin rules to back them up. These may have the force or law behind them. FSSA and DNR-NRC are two areas that come to mind. DNR-NRC just changed the rules to align with state code and allow carry in state parks. Some hospitals and health dept doors are posted and may have force of law.
State house was carry friendly until this year. Lifetime carry license took a lot of people to the capital working over the critters. New rule was blamed on federal recommendations and standards.

Indiana will honor a carry license issued by any state or country in the world. You are allowed to carry within the terms of that license. If that license is from a state that issues a concealed pistol permit then it had better be concealed. If the license requires you to wear a purple hat while you carry then sew it to your scalp (concealed term is serious, purple hat is figurative).

I am not a lawyer and will never claim to be one. Remember to answer El Tejon's question with a big NO. "treat him like he is in a gun store!"

FSSA threatened to close a privately owned daycare in Carmel. I think this was in 2006. Valid or not and with the force of law or not. They did intimidate the owner and in doing so I understand they goofed as far as telling the owner he could not carry at work.
As with the late administrative rule within the DNR on state park carry I suspect there are other state agencies with their own set of rules concerning this. Health Dept is one I am sure they would treat as with the force of law. Pre-emtion at the state level with teeth that govern every state agency should be called for from every rep and state senator.

So, in the city for a conference, training, or visiting relatives?

1. Signs, signs, everywhere a sign. Please refer to Kirk's First Law of the Internet: if it is the law in Texas, it is the law everywhere.

I've never had a sign case. However, please be aware that carrying in violation of a property owner's express prohibition could be construed as Criminal Trespass, a Class A misdemeanor. I think it would be defensible, but have yet to see it prosecuted.

Even though I do not live in Indy, I have never seen a "no guns" signs outside of Dancers West near the airport. I have heard that they do exist but have yet to see it with my own eyes.

2. Concealed carry in Indiana. If you have a license to carry from anywhere in the world and you are not a resident of Indiana, you may carry in Indiana according to the terms of your license. As was mentioned above, if your license specifies a purple hat, you wear a purple hat here. Usually its gun specific as in NYC's carry license or, I believe, California carry licenses (which I have seen twice).

3. Indiana's universal statute is under Indiana Code 35-47-2-21(b).

There is a sign posted at Gander Mountain, near Castleton Mall, but it exempts people with handgun permits.

The only other sign I have seen is the skating rink at W.38th and I-465.

The only no weapons sign I have ever seen was outside a gunshop in Indy. I am pretty sure that the only signs that hold any water legally are the ones on buildings prohibited anyway. That being said, several bars in Indy have metal detectors at the entrance, so I would use caution. I also dont go through Indy without carrying under any circumstances.
