I live in Indiana and have several guns. Both rifles and hand guns. My grandson is coming to live with me and he is on probation for DUI. His probation officer said he couldn't be around guns. Is it true that i would have to get rid of my weapons for that reason or do i just kick him out? Thanks for the help in advance

They just need to be inaccessible to him. Store them in a locked safe or sturdy cabinet that he doesn't have access to, or consider keeping your guns at a friend's place.

Has he been convicted of multiple DUI's that constitute a felony? As I understand it a DUI is normally a misdemeanor and does not prohibit anyone from owning firearms, much less being around them. In most states DUI can only be upgraded to a felony after three convictions or if the drunk driver caused a serious accident that resulted in serious injuries or him being charged with vehicular manslaughter.

The DUI was in Indiana and it was a second one. Indiana says it is a felony. Bu i still don't understand what that has to do with my firearms. They are mine and not his. I refuse to give up my firearms because of his DUI's. Guess he will have to find another place to stay. I think Probation officers go just a little too far telling him i have to get rid of mine. They are mine, I have a permit and i intend on keeping them.

Thanks

With respect to firearms, consider treating him as if he were a child coming to stay with you; no reason to give up your guns, just secure them so he cannot gain access to them under any circumstances.

If that is either impossible, too costly or unpalatable to you, then yeah, let him find somewhere else to live. Sounds like his life train has already taken the wrong track a couple of times, no point giving him the opportunity to add felon-in-possession to his worries.

The point i am trying to make is the county probation dept says i can't have them in my house. Not that i am worried about him getting or using them. I resent the fact that they say to get them out of my home if he moves in with me.

Indiana Law says that a felon cannot have any weapons in their place of residence. If he is living with you and they are your guns it doesnt matter. There can be no guns whatsoever in a felons place of residence.
