We got the letter of dismissal today from Judge Colleen Flynn in Middlesex county NJ who was nice enough to do a phone conference with my wife after receiving our letter requesting the restraining order be dropped. See thread http://www.thehighroad.org/showthread.php?t=511813 Now after being probed every which way but tuesday I can safely say my record is 100% spotless. If anyone is going thru the same issues PM me and I'll share my experience navigating thru the legal system.
 
We are glad to see that at least sometimes, common sense triumphs over the legal system.

I hope you don't mind if I tell people that this is an example of why they need to be concerned about the legal ramifications of what they do. They need to do everything they can to avoid being compelled into courtroom.
 
I've not said much (if anything) about your travails, George--but I will come on now to say I am very, very glad you had the persistence to see this through. Congratualtions!

A hearty congrats to you and I hope you received good advice here at THR.

NOW, while you still have passion abou it, write letters to Congress and Govenors to end the nonsense of Lautenberg and anti-gun legislation pertaining to restraining orders and domestic misdemeanor convictions.
 
Glad to hear it worked out for you. For a while there I was beginning to feel as though you would never see the end of it. I didn't want to jinx you so I never said anything. Good to know there are some in NJ with a good head on their shoulders.

I think this just goes to show you that, you don't necessarily have to commit a crime to be barred from your rights. Sometimes people get the wrong end of the stick, just by going about their lives. You can't always know that what you are doing could lead to such consequences.
 
Glad to hear it got resolved George. I'd STILL Like to know how it happened in the first place. While i dont work in Middlesex, I DO work in Hudson, and i know that before ANY TRO is signed by our Judge he REQUIRES a conference at least by phone with the Plaintiff, unless she' is severely injured or unconcious. What time frame was this issued during? I've been OTJ for almost 23 years here and in that time i think i've seen only two orders issued without the full cooperation and by request of the "Victim", and both of those invovled major assaults with very serious injuries.
 
kdpipes- I should have gone into more detail,when the judge called to speak to my wife to make sure that she wasn't being coerced she had the original transcript in front of her. Apparently when the police came to our house they filed a report recommending a hearing which neither of us remember going to and my wife refused the restraining order but according to the transcript the judge issued it anyway in the best interest of my wife. This was right after lautenberg was law and NJ was passing out FRO's like candy and at the time neither of us understood the ramifications of such an order and ignored it. If I remember right at the time if the cops showed up for any type of domestic TRO's were standard and judges routinely issued FRO's even if both parties refused them. According to the judge the FRO in this case didn't even have my wifes signature on it because she refused to sign it. Either way I'm glad that my record is clean finally after all the lawyers and cash I've spent. I wonder how many other people are out there who have no idea what NJ has on their record being it's the only state where restraining orders don't expire after a set amount of time.
