Jailed for shooting at private range

Very interesting -- according to a search online they're building this bear center located on 50 acres of land and spending $6 million to do it. It's supposed to be some kind of tourist attraction.

And they're building within "20 to 40" feet of the property line, on this 50 acre property, knowing that Limey likes to shoot on his own property.

And with a 500 ft. building ordinance? What a coincidence, eh?

"international wolf center"? give me a break. some rich bitch wants to be "important" (vain), and a cooky neighbor tries to meddle with their desire to be even more "important" by interfering with their construction of a "bear sanctuary".

no such thing as a privately owned "international wolf center", unless it's some internet friends in canada chatting with some fool animal lover by instant messenger. a "bear sanctuary" on 10 acres? hell, i got almost that much ground. maybe i could open an "international buffalo sanctuary". i could get an old cow (close enough) and some cool pictures off the net, spend a lot of time designing a websight, offer private lessons on humane methods for re-establishing buffalo populations in pennsylvania, tell everybody that buffalo are really just misunderstood, and that they are loving and gentle creatures...

maybe an "international conservancy for displaced military automatic rifles"? anybody wanna bring some poor neglected kalashnikovs and fusils over to help me build my population? my current herd is below a stable reproductive level from a genetic standpoint.

10 acres would be about 200mx200m. You're perceptively right, that's not a preserve it's a cooky neighbour trying to keep cooky pets. If anyone should be complaining it's the guy who has to live beside wolves and bears! lol Maybe his neighbours went to the Treadwell School of Anmal Friendship and they'll be out of the picture soon enough "Here girl, I've smeared my hand with honey, come lick it off":)

Of course if that statement is anywhere near correct,Limey should have watched his temper and his mouth.

"No “Swat” team action, the Deputy went over and knocked on Limey’s door and spoke to him.
Empty casings were found, on Limey’s property, within 20 to 40 feet of where the LEOS were standing with construction workers when they had heard the shots."

Any warrant to search his property?

update

the charges have been reduced to disturbing the peace. The Police were basing there case on a few shotgun emptys and a few 45 acp cases WHEN THEY WERE SHOOTING RIFLES! The arresting officer was an Ely cop but hibbing swat was there to do the cuff and stuff. Things should turn out o.k. but it's not over till the fat lady sings.

Made Ely run this weekend to check up on my friend .Talked to several other folks all local and have come to beleve the is too much information both pro and con to make any bold statments about wrong doing on either side. He Limey was jailed over night and relased with no bond court date is on Nov 8TH the team that aresseted him was from Hibbing .This has all the trimings of small town polticts with all the he said they said you could ever want .One of the reasons their was so much firing going on he was doing a break in on a rebuilt 45 ACP pistol .What a way to start out posting on the High Road.

That doesn't sound right. Aren't there "grandfather" acts in Minesota? If he was there first and was shooting, well other buyers beware.

What about the threats to shoot/kill?

Hibbing PD sent a swat team (72 miles one way) to take a St Louis County Sheriff's Office call? And an Ely PD Cop made the arrest instead of a Sheriff Deputy?

Like Hammerxc just said, "what about threats to shoot/kill?" Forget about the fuzzy bears and wolves. And forget about who owns what property. How would you react if some pissed off guy came up to you and said he was gonna shoot you?
The construction worker is just doing his job, earning a living, then is threatened to be shot, which is followed by actual gunshots. Of course he calls the police. The construction worker wasn't trespassing, but was still confronted by Limey. It makes no difference how big Limey's property is, how far the buildings are, or how long who lived where. Limey threatened to shoot and kill innocent people. Limey may have some legitimate complaints, like kooky neighbors and construction noise, but that doesn't give him the right threaten the constructions workers. Threats are not "idle threats" when the threat is followed by action, like gunfire. I don't think Limey is any sort of "terrorist" or is "unstable", he's just a regular guy that lost his temper. A visit by the police and a stern warning is probably all he needed.

I never met anyone involved in this story, and i'm basing my opinions only on what's been posted here. There's still more to the story than what we know. I may change my opinions if new information arises.

All charges dropped. The kicker is that there was a 45 minute gap between the supposed harrasment and the call to 911 just enough time to cook up a story!

To all of you that prayed and gave good wishes thanks.

I haven't read all the messages in this long and windy thread, but from what I did read and from your message to which I'm responding, your friend deserves congratualations on the happy ending for Act I of this story.

Now it's time for Act II to begin. This is the part in which he consults with the best, most experienced lawyer he can find. I gather, from what I read, that your friend was arrested, spent a night in jail, and was humiliated in his community. He deserves compensation. The people to provide it are the neighbors who made the false complaint and the town whose police department acted upon it.

The neighbors who made the complaint that got your friend arrested should certainly enjoy a hefty lawsuit against them. If they want to play they undoubtedly would not mind paying.

My guess is that your friend should be able to get a good lawyer willing to work on a contingency fee basis, assuming that your friend does have a winning case.

I think the more pertinent issue would be the question of curtilage...

ok, rules for new members, no more using words i don't understand!

curtilage?

hmmm......not in my pocket dictionary hmmmm.... is it worth standing up to get the collegiate on the top shelf hmmmm...... not in there either..... ah found it on a web search. guess i need to throw away the paper books now!

S&W 24 - Glad to hear the charges were dropped. I hope your friend can find a lawyer and take the fight to the enemy, so to speak.

Reading this thread has demonstrated to me that, even here, there are those willing - no, eager - to deny that animus against gun owners exists.

There are those, even here, who will jump into conjecture with both feet, imagining scenarios which allow them to find that fault lies with the gun owner.

There are those, even here at The High Road, who will waste no time before chucking that whole "Innocent until proven guilty" idea.

There are those here that should just change their screen name to 'Shill' and be done with it.

There are none so blind...

But there are, especially here, those with the courage to acknowledge otherwise, and offer prayer, advice, and support to fellow shooters. Don't give up on THR!

Any member who feels I was referring to them in a less than complimentary fashion above - well, yeah, I was talking about you. That make you feel any better?

And by the way, in my limited legal experience, no - I've never heard of a plea bargain where the charges were dropped. Who was copping the plea - the DA or the 'dancing with wolves' idiots next door?

Thanks for the update, it is nice to hear good news.
Some times the club (law) swings in the right direction.

Now that he is a free man and won the first part, he needs to file a malicious prosecution lawsuit. This would help check any further attempts by the neighbors to start another incident, which will most likely be more invasive next time, up to farm animals being mysteriously shot.I know, I have run into these types before. They push and keep pushing until told by the law to stop.

Curtilage, acoording to the free world dictionary, is another word for yard. The area surrounding your house.

As far as I'm concerned, if I had all those guns, and there were bear and wolves next door, then I'd be quick to tell them what I may have to do if one of the animals ended up on my property, and would ask for a phone number, just in case...

I might also make it a point to ask the sheriff as well.., My .02.

Quit cigs 1M 15h 11m ago. So far saved $189.79, 1,265 cigs not smoked and counting ...

Glad to hear that Limey's in the clear. Do keep us posted on the case if he decides to file a malicious prosecution suit. I hope he ends up with a couple bearskin rugs.

PS, in legal speak curtilege is the area of your land immediately adjacent to the home. But exactly what it is, nobody knows; if you want to win, argue small yards and big fences. Curtilege is more protected than "open fields" [which curiously enough can be adjacent to the home, posted, fenced, not fields at all, etc., and still not receive 4th amendment protection under the 1960s "privacy" version of the right.]

Thanks for the kind words. I'll pass them on to my buddy. I won't give up on THR yet but it's been hard to see people not wanting to help and not wanting to members of a community.

Charges Dropped!

Excellent!

Yes, your friend needs to take unequivocal action against his persecutors.

Bullies will keep looking for ways to make his life hard until someone drops the hammer on them.

The best hammer is the one the judge holds.

It would also seem that he could have a federal case against them, as his civil rights were definitely bruised in all this. I believe that the abridgement of one's civil rights under color of law is an actual offense.

He's got plenty of paper trail to back him up, now he needs to engage in the best defense: a good offense.

Take the bullies to task and smack 'em upside the head with a legal brick.
