First off, my condolences to Mr Scalia's family. We are a better nation because of his leadership and devotion to his country and the constitution. May he rest in peace.

Obama will surely try to get an appointment during his presidency. Because of his very unwise appointments with present AG (soon to be revealed) and previous AG, I think his judgement regarding any SCJ will become suspect by the senate. His track record here is abysmal. Probably his weakest cabinet appointments excluding Hillary.

Not much to hide here.

I add my condolences. A fine Justice and a gracious man. May he rest in eternal peace.

The prognostications on his replacement can certainly wait. The Republic will survive.

Time to man up, Senate Republicans. DO SOMETHING for a change.

Was that satire? The Democrats confirmed Kennedy after having straight out rejected his original nominee, Robert Bork, and causing Douglas Ginsburg to withdraw his nomination. Justice Powell, who Kennedy replaced, had retired in June 1987. Justice Kennedy's nomination was confirmed February 18, 1988 - Reagan's last year in office; because they had already blocked two other nominees for near 7.5 months.
 
POTUS isn't going t o pass up a chance when a mildly left appointee will shift the center significantly. He still had Ginsburg to go for the big swing to the left.
 
Goodbye Justice Scalia, A very good friend not only to RKBA, but also with the respect He gave the Constitution, his intellectual honesty, and the precedent he set for the world. We dont know what will happen, but this could easily be another defeat bringing us towards the end of a great nation. Lets just hope Those in power who still hold the Constitution as a value can Find the spine to stand strong through this one. I doubt they will.
 
I bet by the end of the week.
I doubt he will be able to contain himself beyond Wednesday.

BTW, my #1 nomination choice (if MM can hold the dogs at bay for the next president [ha]) would be Trey Gowdy. That would put the fear of God in the progressives.
 
Justice Schumer? Justice Feinstein? Justice Bloomberg? Who knows, but it won't be anyone friendly to gun owners. And I see the president making the appointment and declaring that Senate confirmation is not necessary.

Do Thomas, Alito, or Roberts hunt, or do any shooting at all? I have only heard Scalia (of course) and Kagan of all people have any kind of exposure to firearms, if only recreationally. This is DC where guns are essentially banned, and these judges come from cities where guns are despised,

I was assigned to do some work at Justice Thomas's residence several years ago and let's just say that it was in very pro gun location.
 
Justice Schumer? Justice Feinstein? Justice Bloomberg? Who knows, but it won't be anyone friendly to gun owners. And I see the president making the appointment and declaring that Senate confirmation is not necessary.

Try Justice Boxer. She's retiring from her high office in California and has some free time to screw the people in flyover country.

WaPoo's already floating Obama as a nominee --good luck with that; he ain't no Taft no-how :rolleyes:. Although, the futile move would be guaranteed to yield some incredibly nasty Republican sound bites on cue. One comical power-play I thought of just now would be to nominate whoever looks to be Hillary's dancing partner right before the elections :evil:

Glad to know someone may be keeping the faith up there. Like I said, it's just become so easy anymore for that enclave of DC to be completely and utterly insulated from issues like this, and it won't be getting better any time soon; hard to believe anyone in that life can be bothered to shoot or own firearms at all.

Perhaps what I will miss most is Scalia's writing. Very thorough and well-supported, but not so bookish the layman cannot make any sense of it. Pretty much always a very objective tone on things, not in an amoral sense but a 'big picture' one which acknowledges where a particular case stands inside our much larger legal/moral framework; an ability too often lacking in all of judges who don't always seem to grasp the gravity of their rulings/precedents as they are formed. I didn't always agree with his findings, but I did enjoy reading them far more than his peers (Thomas is likewise usually to-the-point enough to keep me interested, but at least with Scalia around he has never needed to be as prolific as I suspect he will need to be going forward)

Pretty sure that's the 'go' switch for a lot more people than anyone on any side of the aisle wants to admit. No, they wouldn't try something that crass when there are as many privately held guns as there are now; Obama would have long since packed the court with new justices during the supermajority years, otherwise.

Now for those whining and groaning, "pull your big boy pants up and get it together!" It's not over unless you guys allow it to be over. Remember, they work for us. I know it certainly might not seem like that and maybe it is all an illusion but only if we let it. If we could come together then we all could remind them that they work for us. It won't be easy but it wasn't easy for those that started this nation either. Now get out there and get to work and quit whining about it. How many of you would actually turn in your stuff or let them come and get it if everything was outlawed tomorrow? Seriously? Up to you guys.
 
Concerning a possible SC nomination, speculation seems to be centered around Sri Srinivasan, a 2013 appointee to the DC Circuit who was confirmed without opposition, 97-0. The argument will be that someone the Senate approved 97-0 2.5 years ago could hardly be unacceptable today. But that was a different Senate. There are a couple of other possibilities, but this seems to be the strongest.

On thought is that Obama might appoint someone like Eric Holder as a stalking horse to draw out the strongest opposition, then withdraw the nomination and send up Srinivasan.
