LE Department only weapons

A gunstore I frequent recently acquired a used Glock 25 and 28 from the local sheriff's department. These guns did not score enough points for importation by the BATFE and where allowed into the country as agency only weapons. Now that the sheriff's department is done with them are they legal to be sold to civies? or can they still be only sold to another police department?
 
After remembering that google is my friend I came across ATF Rul. 74-8 it appears that I cannot purchase these pistols. Too bad.

When NFA firearms are registered on Form 10 by governmental entities, subsequent transfers of such firearms shall be made only to other governmental entities.

Correct me if I'm wrong but NFA are Machine guns, SBR, SBS, DD, Suppressors, and AOWs, and the Glock 25/28 aren't NFA guns, so I'm good to go, right?
 
Seems like they'd be legal to me. They could only be imported for the agency, but you wouldn't be importing them - they're already here.

And, as you just pointed out, they're not NFA items.
 
Nope, not considered NFA... Realistically if it could only go agency-agency how would the local gun shop have got a hold of them legally? You should be good... and when in doubt BATFE and/ or State police are generally more than happy to help you STAY legal in these matters. Give them a ring if you have questions, my experience has been good with both.
 
What's so different about them that cause them to not be allowed to be imported for civilian ownership?

Just curious as a quick google search tells me they are just Glocks in .380.

The Glock .380's are the same size as the 9mm Glocks and are blowback operated.

To answer your question...the Gun Control Act of 1968 prohibited the importation of small cheaply made handguns. ATF developed a point system for importation:http://www.atf.gov/forms/download/atf-f-5330-5.pdf
 
The caliber doesn't score enough GCA points. if you buy them the potential resale on them could be enormous, due to scarcity.

German made Walther TPHs would command a great price. Not so much after they were being made in the US.

ATF Ruling 74-8.

Advice has been requested whether the Bureau will approve
transfer of National Firearms Act weapons by a State or po-
litical subdivision (Police department) to a special
occupational taxpayer where such firearms were, registered in
the National Firearms Registration and Transfer Record
pursuant to 26 CFR 179.104. 26 CFR 179.104 provides that any
State, any political subdivision thereof, or any official
police organization of such a government entity engaged in
criminal investigations, which acquires for official use a
firearm not registered to it, such as by abandonment or by
forfeiture, will register such firearm with the Director by
filing Form 10 (Firearms), Application for Registration of
Firearms Acquired by Certain Governmental Entities, and that
such registration shall become a part of the National Firearms
Registration and Transfer Record.

The purpose of the above regulation was to permit the limited
registration of firearms by certain governmental entities for
official use only. 26 CFR 179,104 may not be used as a vehicle
to register otherwise unregisterable firearms for the purpose
of introducing such firearms into ordinary commercial
channels. Accordingly, when registration of firearms by
governmental entities are [SIC] approved on Form 10, the form
will be marked "official use only." The Bureau will approve
subsequent transfers of such firearms only to other
governmental entities for official use. Otherwise, such
firearms must be destroyed or abandoned to the Bureau.

Yes, a Title 1 firearm imported for LE/Gov/Mil use can be re-sold to civilians, after the exempt agency no longer has a use for it.
 
Do these Glocks come with the box and papers? I would buy both of them if I were you. The Glock 25 and 28 are both hard to come by in the States because they do not meet import requirements and can only be imported for military or LEO use. You can buy it though from say a police officer. You can probably sell it later to a Glock collector.
 
They are legal for you to buy used, not new. Buy them. You can always resell them later for more than you paid for them.
 
I am not sure that this is the same thing, but after the Clinton Ban, Magazines over 10 rounds, and a large number of black rifles and carbines were sold with stampings "LE use only" , Meaning that you had to be LE to buy them, today, the markings were pretty much useless, as the Magazine capacity ban is gone.. Would these pistols possibly have been made during that time Frame..... Just wondering...
