Legal question about Romanian AK parts kits.

Hello everybody. AIMSurplus as well as many other businesses have Romanian parts kits for about $90-$100. I've been thinking about ordering one or two to toss in the back of the shed incase there's ever a future ban and we can't by AKs anymore I'll have spare parts.

My question is about the legality. I don't want to have a parts kit lying around where somebody could say I'm trying to build a machinegun.

If you have an AK receiver and buy the parts kit, then you do have a worry. ATF does consider that a machinegun. That is why the kit comes with a torch cut receiver. Now if you have a friend or relative and they do not own an AK receiver and would like to store a parts kit in their closet, that is perfectly legal. :)

I don't have a bare receiver, but I own a WASR.

Is it still illegal for me to have an extra kit for parts?
 
What you have is an AK with a semi-auto reciever. Legal to have spare parts for that, and the kits are just spare parts.

I believe what HK was saying is when some certain holes (necessary for full auto fire) are drilled in an AK reciever, it coupled with the parts kits becomes constructive intent. You should have no problem.

But, I am not a lawyer.

It wouldn't make sense to me for all these companies to sell AK kits and not put huge disclaimers on them if they would get us in trouble with the law.

Once I get some more input on this I'll be glad to get an extra kit or two for spare parts. :)

Not exactly. If you buy the parts kit and it contains the full auto parts of a true AK-47 type rifle and you possess a semi-automatic AK type rifle, ATF says you are in possession of an unregistered machinegun. If you want to buy spare parts, make sure the company is not sending you full auto components. It is not the company's responsibility to ensure you do not violate the law.

The disclaimers are usualy there in the ad: ALL NFA RULES APPLY
 
I bought a couple of these kits from AIM and they did not come with the auto sear. also none of the commercially available receivers have the 3rd "evil" hole for the auto sear. therefore even if you had it you could not fit it.
 
Toss the autosear and make sure your reciever doesnt have the holes for the pin, and you're set with regards to that one.

Now, they might try to get you for conspiring to violate the import ban if you have a bare reciever and a 100% imported parts kit, so buy a US parts set and you'll be ready to go.

I've built a number of AK's and it's all legal as long as you follow the stupid import rules. You can't put more than 10 imported parts on any rifle so that means on an AK you just have to make sure you swap out 6 parts with U.S. made ones. Usually it ends up meaning you use a U.S. made receiver, trigger, disconnector, hammer, pistol grip and gas piston. There are a few other choices though.

As far as the Romanian kits from AIM, mine all came with a rate reducer and auto-sear just no full-auto disconnector. Not that it matters anyways since you end up junking these parts or swapping for U.S. made ones to meet the parts count rule. It doesn't matter if you have full auto AK parts sitting around either because on the AK a receiver with the third hole/rail slot is the only part that is considered a machine gun.

No wife, but that's probably why. :)

It was actually part of the degreasing stage after sandblasting and before the paint. Thanks to fast food and the microwave I'm positive that my oven gets used far more for guns then food!
