Legality of ASP or Baton in Kali

I have a friend in the San Diego area that has a little fan that is 'stalking' and severly harassing her. are ASPs (colapsable batons) legal for civillian ownership?
 
Can't use them in CA. Not legal for use by civvies.

Peperspray, maglight, blade, dog or firearm (on private property).

fatboyclone: As far as I know, us "ordinary" citizens are prohibited from possessing them here in CA. :( The good folks at San Diego's "California Police Equipment Company" told me as much when I asked them about the ones they sell.

The strange thing is, I can't find the actual spot in the law where they're banned. A quick look at http://caag.state.ca.us/firearms/dwcl/dwc.htm, which references PC 12002, shows a list of people who aren't prohibited from possessing clubs/batons/"assault"-sticks, but I see nothing there prohibiting them so long as they aren't "nunchaku".

Unfortunately, http://www.leginfo.ca.gov/calaw.html is screwed up at the moment; it's returning irrelevant results from our great state's Health and Safety Code. To go out on a limb, based on the wording of PC 12002 and friends, I think it's safe to assume that it's illegal for your friend to have basically any blunt object for which she can't convincingly explain a legitimate, non-"assault"-thought purpose. D-cell Mag-Lites are good for that; you never know when you'll end up in a power outage or with a flat tire at night...

Remarkably, this state still trusts us with our car keys, shoelaces, and folded knives.

She may want to look into protective/restraining orders, depending on the situation. I don't know much about those, myself. Seriously, she should just call her local cops (or walk into a station), explain her situation, and ask their advice.

Cops around here also have it in their heads that people with ASPs are all nutjobs and that the ASP is their version of a lightsaber. they get irate at the very least if you have one.
 
Someone posted recently about using a stick to 'stretch' before and after jogging in public. Do this in a public place, so that witnesses can be called upon to prove it wasn't being carried as a weapon... only used as one when needed.

Tell her to forget about it quick. Collapsible or even non-collapsible batons are a FELONY in CA.

Carrying a handgun illegally is only a misdemeanor, however...

I'd venture to say that a woman who can prove she was in fear of her life would fare pretty well in the legal aftermath.

If she had a paper trail, ESP. a restraining order, she'd be golden, IMO.
 
A stick, a simple technology thousands of years old. Banned. A simple metal stick. GET ME OUT OF THIS STATE!

California Penal Code (PC) 12020. (a) Any person in this state who does any of the following is punishable by imprisonment in a county jail not exceeding one year
or in the state prison:
(1) Manufactures or causes to be manufactured, imports into the
state, keeps for sale, or offers or exposes for sale, or who gives,
lends, or possesses any cane gun or wallet gun, any undetectable
firearm, any firearm which is not immediately recognizable as a
firearm, any camouflaging firearm container, any ammunition which
contains or consists of any flechette dart, any bullet containing or
carrying an explosive agent, any ballistic knife, any multiburst
trigger activator, any nunchaku, any short-barreled shotgun, any
short-barreled rifle, any metal knuckles, any belt buckle knife, any
leaded cane, any zip gun, any shuriken, any unconventional pistol,
any lipstick case knife, any cane sword, any shobi-zue, any air gauge
knife, any writing pen knife, any metal military practice
handgrenade or metal replica handgrenade, or any instrument or weapon
of the kind commonly known as a blackjack, slungshot, billy ,
sandclub, sap, or sandbag.

In this code section, the term "billy" is generally believed to include a "baton", even though "baton" is used elsewhere in the Penal Code, no express definitions can be found.
The crime is considered a "wobbler" in California; one which can result in either a misdemeanor (county jail) or a felony (state prison).

I forget. I believe that, according to the letter of the law, mere civilians in CA are not allowed to own collapsible batons at all, but I sure may be wrong.

I had no problem getting one online, as most online vendors take the approach that "buyer must be aware of all local laws; we take no responsibility."

I know for a fact they are illegal to carry (as is made clear in this thread.)

But just own? I'm not sure....how would you get caught with it in your own house anyway?
 
I think it is the same deal for a simple baseball bat. I think you can't have one in your car unless you can prove you're going to or from sporting events.
 
I think a sjambok would be a good alternative here. Not as concealable as an ASP, but then it makes it hard to pin it as intent to carry it as a weapon since it's out in the open.

If anyone asks, just have her say she's scared of rabid dogs or snakes.

Good call. The cane used as a defensive weapon with a few basic skills drills. Out in public, they are not noticed very much at all for what they can be.

It's a medical aid, anything the airlines allow you to board with should be legal about everywhere I'd think.

The woman in question may not take to carrying one or training with one but the idea is valid and defensable if you have to use it. The mere fact she has a cane in her hand may deter the stalker a little as well, or it could be viewed as her being an easy victim.

her to carry a grande vaquero (cold steel) per Jim March's website,they are legal to conceal. They are scary!

An asp or baton or nuchucks are a felony! even in your house...I heard there is some provision for karate students for nunchucks but I think they have to be kept in the school.

in her house she could have a baseball bat though,tell her to play softball now and then,maybe she could get into golf as well. We have a golf club hidden near the front door,and some balls too (golf balls)
