Montana Firearm's Freedom Act

Looks like Montana is giving a big "up yours" gesture to the feds with this bill. The 13 colonies declared independence from Britain for far less than what this bill would change.

If Colorado gets any "bluer" I'm going to start looking to live elsewhere ... I'd been considering Wyoming (I still want to be in the Rockies) but Montana sounds better all the time too.

Although to be honest after all the damn "Global Warming" this winter, I'm seriously considering moving to a warmer climate :p

This is a great thing. I'd like to see this happen in Alabama. Any AL brothers here feel free to PM me if you wish to discuss methods to make this happen.

I'm thinking I'm going to forward this to my local "Red" representatives... NH is 50/50 right now, because of all the Mass. Liberals that have infested, but the state has been pretty pro-gun throughout it's history... There's a chance it could pass... "Live free or die" is taken quite seriously here.

Quietearp - The Montana Legislature does not have the authority to define the commerce clause of the U.S. Constitution. That is up to the U.S. Supreme Court. The authors can include all the language they want saying the commerce clause doesn't apply but that means nothing. There have been many, many federal court decisions on the reach of the commerce clause and this legislation won't work.

The state of Montana is nothing more than a geopolitical boundary, what makes things inside it's boundaries great or appealing is the people within those boundaries.
Apparently the people which reside within it's boundaries elect leaders that "stick to their guns", no pun intended, and refuse to be bullied by anybody.
They are a breed apart which harkens back to a time when Americans were self-reliant, independent and self-assured.
They have yet to be socially mentally castrated like the rest of these sheepherd states.
I have their mentality, but reside in a state whose majority refuses to elect officials with cajones.

I'd love to see NH do something like this too, but I fear the Mass. invasion may be too far along for it to happen.

I've spent the past few hours researching the Senate and House for NH... It's a low chance, but still possible. If just 3 of the dems in the senate are pro-gun, we'd probably make it.

The reps for my area are 80% republican, not sure about the rest of the state.

I'm emailing a few different members here shortly.

Word for word... my thoughts exactly.

Wyoming also spit in the fed's eye regarding the 55mph speed limit, and they are as west as it gets. I'll move to Wyoming if this state's crap keeps up. I gotta stay in the Rockies where I can hunt elk, and Wyoming is calling.
The saying goes...

Wyoming is what America was.

The more states that pass a law such as this, the less likely the Feds could do anything to enforce any laws that attempt to usurp constitutional rights.
It's been a long time since the 9th and 10th Amendments meant anything...but that doesn't mean they cannot be revived.

"What a great State!"

Indeed. Let's hope this passes, is challenged, and passes that too.

NEW SECTION. Section 5. Exceptions. [Section 4] does not apply to:

(1) a firearm that cannot be carried and used by one person;

(2) a firearm that has a bore diameter greater than 1 1/2 inches and that uses smokeless powder, not black powder, as a propellant;

(3) ammunition with a projectile that explodes using an explosion of chemical energy after the projectile leaves the firearm; or

(4) a firearm that discharges two or more projectiles with one activation of the trigger or other firing device.

a 20mm rifle can still be carried and used by by a single person.... well some of them can.

edit: it appears a 37mm cannon is still under 1 1/2 inch, just can it be carried by a person
