Dayton Man Fights Back During Robbery Attempt

DAYTON, Ohio -- A Dayton man fought back against two
suspects who police said were trying to rob him early
Friday morning. The incident happened around 1 a.m. at
the intersection of Catalpa and Riverview.

Police said the victim opened fire, hitting one of the
suspects multiple times.

Investigators said the victim was walking down the
street when, he said, someone came up behind him and
pushed him. He said when he turned around, there were
two men standing there who demanded his money with a
gun.

The victim told police that he pulled out his
.40-caliber handgun and fired off close to 10 rounds,
striking one of the men. Officers said the men ran
off, but were later found at Good Samaritan Hospital.

Authorities said one of the suspects is a 17-year-old
who suffered multiple gunshots and remains
hospitalized. Officers said they also arrested two
16-year-olds who they said was driving a stolen car.

Police said that all three men face charges of armed
robbery. Investigators do not plan to charge the
victim for shooting the gun, because police believe
the man was acting in self-defense. They said the
victim also had a permit to carry a concealed weapon.

At this time, police are looking for the gun that was
used in the attempted robbery.
 
Heard this one one the local talk radio station today...nice of them to mention that he was a CCW holder and that he acted properly and in self-defense. Hopefully, stories like this will get the BGs asking "is it worth dying for?"
 
Why are three persons being charged with armed robbery when there were only two robbers? :rolleyes: :cuss:
 
It sounds like he was driving the get away car, so he is charged with the crime as well.

Not that I know anything about this, but I read the story as they arrested one guy in the ER with multiple gunshot wounds. They then arrested to more kids driving a stolen car that were appearently involved in the original incident.

Man with concealed-carry permit shoots gunman

DAYTON | Two men carrying guns approached a 40-year-old man at Riverview Avenue and Catalpa Drive early Friday. Their victim bent over with outstretched hands.

The targeted man pulled out a Glock 23 handgun — he has a concealed-carry permit — and fired several shots, hitting one of the gunmen, police said.

Police were dispatched to the 2000 block of West Riverview at about 12:45 a.m. on numerous calls about a shooting.

Police found the 40-year-old male victim at his Dayton residence. He told them that he was walking west on Riverview when he was approached by two males in dark clothing coming from Catalpa. One shoved the victim, the victim turned around and both men in dark clothes flashed handguns, police said.

The victim then "began to back away in a bent-over position with his hands outstretched," according to a police report. Then he pulled out a Glock 23, a .40-caliber handgun, striking one gunman several times, police said.

The two ran off, but police said they caught up with possible suspects at Good Samaritan Hospital.

The victim has both a Dayton Firearms Owner's Identification Card and Montgomery County Concealed Carry Card, police said.
 
What I find most fascinating is that he had a Dayton Firearms Owner's Identification Card (FOIC).

I'm friends with a number of gun owners who live in Dayton, and none have ever bothered to get a FOIC.
 
What exactly is a Dayton Firearms Owner's Identification Card (FOIC)? I've never heard of it before.

§§ 138.11 Firearm owner's identification card required.

(A) No person shall possess any firearm, unless such person has a firearm owner's identification card issued to him/her and in effect under § 138.13, or is exempt from the requirement of an identification card under § 138.22, or is on a duly licensed and suitable firing range.

(B) No person shall sell, deliver, transfer, or furnish any firearm to any person, unless the transferee exhibits a firearm owner's identification card valid on its face and issued to the transferee under § 138.13, or unless the transferee exhibits evidence that he/she is exempt from the requirement under § 138.22.

(C) No person shall sell, deliver, transfer, or furnish any firearm to any person without first having notified the Director and Chief of Police of his/her intention to do so not less than five days prior thereto. Such notification shall be in writing, and shall contain the name, home address, social security number, and firearm owner's identification card number of the intended transferee. The Director and Chief of Police shall prescribe the form for such notification, and shall make them available upon request therefor.

(D) Every person regularly engaged in the business of selling or trading firearms at wholesale or retail whether as the principal business of such person or in addition thereto, having sold, delivered, or furnished a firearm to any person pursuant to the provisions of subsection (C) above, shall within five days thereafter, furnish to the Director and Chief of Police the details of such transaction, including the name and address of the transferee, his/her firearm owner's identification card number, and a description of the firearm obtained, including the manufacturer's brand name, caliber, and serial number.

(E) No person shall use or attempt to use a firearm owner's identification card to obtain any firearm, knowing such identification card to belong to another, or knowing it was obtained by means of false information, or when it is void by reason of the holder becoming a member of the class of persons prohibited by § 138.14 from being issued a firearm owner's identification card.

(F) No person shall use or attempt to use his/her firearm owner's identification card to obtain any firearm for any person who does not have a firearm owner's identification card issued to him/her and in effect under § 138.13 and is not exempt from the requirement of an identification card pursuant to § 138.22, and no person shall knowingly permit his/her firearm owner's identification card to be used by another to obtain any firearm.

(G) No person shall knowingly furnish false information when making application for a firearm owner's identification card.

- The cost for the FOID is $25 every three years.

Thanks Molon Labe. I've got a few friends that live in Dayton, and I've lived there myself in the past, don't know anyone that ever had one. Part D smells like registration.
