Dear *Fletchette*:



Thank you for contacting me with your thoughts on the recent court decision concerning the gun ban in Washington, D.C., as well as your support and willingness to volunteer your help in protecting our Second Amendment rights. It was good to speak with you and your wife at my recent town hall meeting in Wheatland in February.



I am strongly opposed to any limitations on the Second Amendment rights of law-abiding gun owners. On March 9, 2007, the D.C. Circuit Court addressed this issue. The ruling by the D.C. Circuit Court stated that ".the Second Amendment protects an individual right to keep and bear arms. That right existed prior to the formation of the new government under the Constitution and was premised on the private use of arms for activities such as hunting and self-defense, the latter being understood as resistance to either private lawlessness or the depredations of a tyrannical government." Also included in the majority opinion of the court is a rejection of D.C.'s constitutional status within the United States. The argument states that because it is not a state, the Second Amendment does not apply to it. However, the court rejected this as unconstitutional. I was pleased that the courts have upheld the Constitutional rights of the citizens of Washington, D.C.



As you noted, I have previously cosponsored legislation that would have allowed residents of Washington, D.C. the right to own firearms and keep them in their residences. I noted your comments about other legislative ideas concerning gun rights. I will discuss these ideas with my legislative staff and continue to support gun rights legislation. When gun rights bills come to the Senate floor for debate, I will keep your comments in mind and not waiver in my convictions.
