Senate is Trying to Subvert the Will of Voters:
STOP GUN OWNER HARASSMENT COMMISSION!!!

[Analysis] Remember how we warned you that despite gains at the national level, the results of the last election produced serious threats to gun rights in North Carolina? Unfortunately, we were right.

Here is a tale of how NC Senate Rules Chairman TONY RAND (D-Cumberland, GRNC 0-star) passed a bill creating a Gun Owners Harassment Commission without giving you, the gun-owning voter, the slightest chance to provide input on the process.

Our tale starts in 2002, when limousine liberals from Chapel Hill calling themselves North Carolinians Against Gun Violence got a $50,000 grant from liberals from San Francisco calling themselves Americans for Gun Safety to pass a gun trafficking bill in North Carolina. Using radio spots directed at the governor's office, GRNC successfully suppressed a hearing for the bill which killed it.

Now cut to 2005, when Rand introduced SB 892 to create a gun trafficking study commission comprising appointments from a broad spectrum of anti-gun politicians and bureaucrats, all tasked with harassing lawful gun sales. Gun shops, gun shows, purchase permits, the whole spectrum.

Under pressure from GRNC, of course, the bill went nowhere. The Senate knows full well what a ruckus we can create over anti-gun legislation. Not to be deterred, however, in a single day, yesterday, Rand got his bill out of the Senate and left few options for defeating it in the House. Here is how he did it.

PICK A BILL, ANY BILL

All of this occurred on August 24, 2005: First, they took HB 1269, pertaining state use of land, and hatched a plan to strip all of the language, change the title, and add gun control. When that was revealed, they changed the plan to put gun control into a different bill, HB 413, which also had nothing to do with guns, and had been sent to the Senate
AFTER passing in the House.

In a bad replay of Invasion of the Body Snatchers, they took the bill out of the Senate Education Committee, referred it to the Senate Rules Committee (chaired by Rand), changed its contents and title, and passed it on the Senate floor in both Second and Third readings, finally sending it back to the House for concurrence. Worse, because the House had already passed the original version of the bill, it can't be amended to remove the gun study commission; House members can only vote for or against concurring. Worse, because the bill contains EVERYBODYS pet projects, they won't want to vote against it.

OUR OPPORTUNITY

Unlike the Senate, however, the House under Speaker Jim Black is still relatively honest: Rather than passing it ASAP, we have a few days to respond.

Honorable Members of the North Carolina House:

I strongly urge you to vote **not to concur** on House Bill 413: The Studies Act of 2005. Unfortunately, it has befallen you to stop a dark-of-night plan hatched in the Senate to saddle North Carolinians with a Gun Owner Harassment Commission. Although HB 413 was originally titled, Global Education for Students/Study, it is now a study commission bill into which Senator Tony Rand quietly inserted his moribund bill to create support for hindering lawful gun sales and restricting gun shows.

By sending HB 413 to conference committee, you will give gun-owing voters the opportunity to provide input. Rest assured that this attempted end-run around North Carolina voters will not be forgotten in the next election. I will be tracking all votes on this bill.
