HB 1415 Designed to Register Gun Owners

[Analysis] HB 1415, "Gun Owner Registration Act", was scheduled for a 2nd reading today and is scheduled for a 3rd reading tomorrow, Tuesday, August 22. It had the original intention of simply reporting back to the home county sheriff if a person was denied a pistol purchase permit in a different county. As bills involving guns tend to do, this one has been amended beyond recognition. In its present form, it now will register anyone who is denied a permit in a DATABASE with the State Bureau of Investigation.

The House has attempted to pull one over on you by amending and fast tracking this bill in order to avoid constituent input. In its present form, HB 1415 is unnecessarily obtrusive and is opposed by GRNC.

MAKING A BAD BILL WORSE

To add insult to injury, WILMA SHERRILL (R - Buncombe) has introduced an amendment to include people under protective orders to this database. People under protective orders have not been convicted of anything and in fact may not have even had an opportunity to defend themselves in court.

Rep. Sherrill would do well to remember another Republican named Don Munford. Munford, as you may recall crossed gun owners as the sponsor of the "Homicide Prevention Act" which seizes the firearms of anyone who is the subject of a protective order. Domestic Homicides have jumped dramatically since that passed into law.

As a result of this slap to gun owners, GRNC ran radio spots against Munford during a hotly contested primary, which he narrowly eked out the nomination. Munford went on to lose to his opponent in the general election.

SHERIFFS' DESCRETION BROAD IN DENIALS

In the matter of Pistol Purchase Permits, a county sheriff's discretion in issuing a denial is broad. The reasons are too numerous to fully quantify her, but for instance a sheriff is allowed to set the number of permits he will grant in any given period. So if the sheriff decides that he will only issue three permits a year and you apply for a fourth one that would be grounds for denial. In that case you would then be registered in an SBI DATABASE!

I am OPPOSED to HB 1415, "The Gun Owners Registration Act." I urge you to vote against this act and use all of your influence to prevent it from becoming law.

As it now stands, this bill is obtrusive and Orwellian. The reasons for denial of a pistol purchase permit are broad and sometimes arbitrary; hardly a sound reason to register gun owners in a permanent SBI database. In addition to this, the Sherrill amendment would register a gun owner in a case where he is "Guilty until proven Innocent."

HB 1415 is a bad bill and any vote for it will be counted as an anti-gun vote by GRNC. I will be monitoring the progress of this matter. Please vote AGAINST HB 1415.

Just another reason NOT to buy a handgun in NC.

They already keep for 10 years or more a list of whoever buys a handgun already.

You want a gun? Buy a rifle or shotgun.
 
Let's contrast this with New Jersey, shall we?

All applicants for any type of firearm license are Registered for life.

Having been granted the NJFID means that you are now legally obligated to report to the police any history of having moved anywhere, within 30 days, or face criminal penalties.

I still don't know exactly what they look for WRT mental health, but they make you waive a certain amount of your medical privacy (in a really serious, disgusting way) in order to dig up an excuse to deny you.

Here in New Jersey, all gun owners are guilty until proven innocent, as a matter of course. You can be arbitrarily denied by any Chief, and you will lose your "gun rights" (if you want to call them that) for Life.

New Jersey, apparently, is being used as an example by these people drafting the NC bill. The similarities are too numerous to ignore. This is what they want for you, in your state.
 
So with this bill, if a pistol permit is denied for any reason, that person goes on a list? Am I correct in this?

I emailed, but only recieved one response so far. While I'm not personally worried about it, I do agree it is a step in the wrong direction.
 
Wasn't there just a thread that questions the "what happens in CA will spread like a cancer to the other states"?

I wish you luck. I suggest you write lots of letters to your reps.

This thing passed the second and third readings. Where does it go next? Anyone know?

To the Senate. If it passes all three reading in the Senate *** As written when it was sent to them *** then it goes to the Governor. However, if the Senate Amends just one word, then the Senate hears it three times with the new language and sends it BACK to the House with their changes. This process continues until BOTH the House and Senate read the Bill (and vote) on the SAME LANGUAGE three times before it goes to the governor.

So, this bill, and the other bill that is being sent through today which establishes a handgun Commission in NC is now in the hands of the senate. Our goal will be to strip the dangerous stuff out in the Senate each time the House sends it to them. This however is hard to do because we have one party that runs both the House and Senate.

One wonders if some sheriffs may judge anyone who owns guns to not be of "good moral character."

The North Carolina Department of Cultural Resources MANDATES that NC sheriffs keep all records and applications for pistol/crossbow purchase permits for 10 years and then must destroy them.

These records ARE PUBLIC RECORDS.

That means anyone can go into the sheriff's office request a copy of your pistol purchase permit and a copy must be provided to them.

A newspaper say could sue the sheriff for such information and publish it every week.
 
"Guns, officer? I never got around to buying any guns with those permits. I kept loosing the permits, except for a couple of expired ones I have somewhere around the house." :D
