NICS is VERY frustrating!

Just went to pick up my P95 from the Pawn Shop and got a freaking DELAY. I get so sick of this.

Sometimes I get a proceed and sometimes I get a delay. Is there any rhyme or reason?

To top it off sometimes they call back within 24 hours or they just let the 3 day waiting period expire.

I called the BATFE and they directed me to the FBI and they are "looking" into it.

Thing is I am a C&R holder as well. I just wish the NICS folks could get their stuff straight.

Me and my buddies want to go to gun show out of state, but I hesitate as if I see a firearm I want at a great price I don't know if I can get it because of the delay or proceed.

I wish there was some card I could buy, anyone have any insight or do I get more vague explanations?

There are a few members here that love the NICS system, don't think it infringes upon anyone's 2A right, and wouldn't change it for the world. When you go posting stuff like this, it just produces evidence against their position.
 
Entry into the VAF will not automatically result in a proceed response on subsequent purchases. A complete NICS check is still required and will result in a denial if additional prohibitive information is discovered.

This was taken directly from the front sheet of the VAF form. If it does not automatically result in a proceed then what exactly does a VAF do?

I know that I will either get a proceed or the time required will lapse. I am wanting to circumvent the delay process as I am a law abiding citizen. What if I am out of state and want to purchase a rifle at a gun show? I would have to come back in 3 business days?!!!!

I don't dislike the NICS system. I am just wishing for consistency.

What a VAF does is allow your records to be kept on file, so when a check is called in on you, the analyst already has the info that will allow for a proceed if you do not have any prohibiting records. It is law that all data derived from a NCIC check is to be destroyed before the next business day. If you get a proceed after a delay, that means someone pulled your records and determined that you are OK. A VAF allows the records to remain in the system for the next check.
 
There is likely someone with the same name, or similar name that is prohibited.

Google your name, I am always suprised how many people have the same name, First Middle and Last (And my name isnt terribly common, especially my last name.
 
You can undo some of the protective limitations put in place to limit abuse of the NICS system. Allowing who you are and what you are doing to be more accurately tracked. Which in turn allows them to know it is the same citizen trying to purchase a new gun.
Think of it as a social security number or Real ID tied to your gun purchase.
So the next time you want to buy a gun they instantly know who it is because you have specifically allowed them to maintain records on you through your request.
 
This VAF sounds like a double edged sword. In one instance it would probably allow me to have proceeds instead of delays. In another instance it sounds like they can legally keep "tabs" on me and keep a total of how many and what kind of firearms I posess. I like that even less than delays.

The FFL doesn't give the FBI any info about the firearm other than whether it's a "Long Gun", "Handgun" or "Other".
 
I have a friend tnat has an Evil Twin that has the same common name and birthdate. The SSN and town of residence are the only major differences. Oh and the others lengthy felony record. He is trying to get his UPIN so that the paper pushers can see he is not the other bright bulb. In his case I think it would be a benefit. I used to kid him about his evil twin being in handcuffs on the TV whenever it happened but in reality feel sorry for my friend.:banghead:

Apparently you're getting consistency, it might not be the consistency you'd like but you're consistently delayed or proceed. :D

You might want to consider getting a Concealed License (assuming the Concealed license has a NICS check as part of the background check), since you have a background check done for the license, it can be used by the FFL and you might be able to bypass the NICS check, at least federally, whether this is ok in your state or not I don't know, nor do I know whether your CCP/CPL/CHL/et al has a NICS check as part of the check.
 
^^^It's okay in AZ...no waiting on NICS and dealers love it when you bust out your CCW they don't even have to call!

Yup, I was just surprised that no one had mentioned this earlier Willy. I had to do some re-checking to confirm I wasn't losing my marbles or going prematurely senile, pulled out my ATF regs and there is was, and double checked the 4473 too section 21 "No NICS check was required because the buyer has a valid permit which qualifies as an exemption to NICS". I've only had my FFL for 2 weeks, gimme a break :)

I mean a UPIN is nice and all but why waste time if you don't need to. Go in drop the cash, drop the license, walk out, thank you very much.

Of course I don't know Missouri statute like the back of my hand, but IIRC there's no Brady Check, and all sales go through NICS. I might be wrong, so the OP should check it up themselves, with their FFL or state law first.

Any Ohio FFL holders out there know if Ohio accepts the CCL instead of going through the NICS background check on a hand gun purchase?

Get a UPIN number or get a CWL, CCDW, CPL, etc and hope you live in a state where the possession of a concealed weapons license will make it so you will not have to do a NICS check.
 
If you put your SSN on the form you usually don't get a delay, if your a smith, jones, etc you are very likely to get a delay.
