No NICS delay now

Because the topic of NICS delays has come up before, along with a myriad of theories as to why, I thought I'd share this experience in the hope it may be useful to others in the future.

I purchased a new NAA .22 mag pocket gun today, my first NICS check since becoming a naturalized US citizen. I have never, ever been anything but delayed, well, denied once but we got that sorted out. Even with a VAF and a UPIN, always a one to two day delay.

I did write to NICS promptly after taking the Oath of Allegiance, asking them to make a note in my VAF since my answer concerning citizenship on 4473 would now be different. I had no idea at the time if USCIS talks to FBI etc, so better for them to hear it from me.

Anyway, the transfer was instantly proceeded :)

I realize this is one data point which does not a trend make, but in my case at least, I agree with my FFL that being a Resident Alien was the reason for the delays.

I can add another data point. As a Resident Alien, I was delayed by NICS on each of my purchases. Getting my TX CHL ended the inconvenience since then there was no need for the check at all. Congratulations on acquiring citizenship - I will be eligible to apply for mine next year.
 
Since you're now a citizen, they probably do not do the AIQ - i.e. "Alien in Question" check anymore. Since I'm still a LPR and I actually have a WA State "Alien Firearms License #" (though not required unless you want a CPL) I still have a wait on pistols, and a few hours delay on long arms...

Now if I can round up ~$700 I'll get my citizenship too...

Actually the alien firearms license is only required for non-resident aliens. If you are an LPR with a green card you don't need that any longer, not even for a CPL.

In fact, if you apply for your CPL now, it will eliminate the need to endure a NICS check for you. AFAIK, BATFE has approved WA's plan to bypass NICS for CPL holders, but it is waiting for some small matter to be cleared up before being put in place. For CPLs issued before the cutoff date, those permit holders will still be required to pass a NICS check for transfers. I'd suggest checking what the cutoff date is so when you do go to all the trouble, you'll have the "right" CPL.

BTW, new CPLs and renewals will now have to pass a NICS check, this was not previously the case.

Being a citizen also negates the requirement to prove 90 days of state residency on every transfer :)
 
Yep, I understand I do not need my AFL anymore, however I apparently have the first one issued since the DOL started re-issuing them... see the many threads on the AFL debacle posted on this forum.. lol

I had my AFL anyway and I just renewed my CPL, it is good til 2016... I had no NICS check on my renewal, just the local town Deputy, his daughter is friends with my daughter, so he pretty much just dropped by one evening and copied my paperwork... small towns can be nice for that sort of thing.

CPL in the PO Box the next day.
