I just read that my state, (virginia) is going to congress this week to have a bill passed that would make "text messaging" while driving illegal.........Also granting police the right to pull you over and ticket you for such an offense.......

My question is this: SInce it is perfectly legal to talk on the cell phone and make calls in Va, how could the ticketing officer prove in court you were in fact sending text messages rather than making a phone call?

If the officer suspects you of texting that's probable cause to believe a crime is being committed. They have grounds for a warrantless search of your property including your cell phone. They must act RIGHT NOW to prevent you from destroying the evidence. No time for a search warrant. If the cell phone logs show a text message at any time the officer says you were under observation you are getting a ticket. If you told the officer you weren't texting you are going to jail for obstruction of justice and lying to a police officer during the commission of his duties.

Man I wish I was joking sometimes....
